German citizenship for a child born here

Toggle
hello,

I heard if a child is born in germany after 2004, he/she will get citizenship if the parents opt for it. The child can get a german passport now evenif none of the parents are citizens.

Does anybody has real experience? We are expecting our kid soon
thanks,
marjan

Hi Marjan

Regrettably you are wrong.

Some of the members of the Forum have children borned after 2004 (I mention myself as an example) and NONE of our children had got the german citizenship.

Your child only can be German if:

1- One of the parents is German
2- After 8 years in Germany (but only if at least one of the parents have a permanent residency)

The thing is more or less complicated and I'm not very familiar with the subject, but in addition to that, at a determined age (I think 16?) the child must decide by him/herself for ther original nationality or for the German nationality.

Hi Marjana

Congrats you NE

Well. I think by now NE don't help very much.

BUT please read the thread of Nobody/DvD about German Citizenship because is possible in the near future somebody with NE can be a German citizen without the 8 years waiting time. If you become a German your son/daughter also can be German.

Marjana,

you are probably looking for § 4 III StAG ( http://www.aufenthaltstitel.de/stag.html#4 ).

Some German authorities know and accept this law, others need "help" from lawyers or judges...
