Dear friends.

Let us share knowledge regarding law about Permanent residence for highly qualified Research Scientist. Is IT specialist with more than three yeras teaching experience as a Lecturer and now working as a highly qualified Research Scientist with BAT IIA salary eligible for Permanent Residence permit? Let me know if somebody has got it under this law!

Also explain me about " Wissenschaftler mit besonderen fachlichen Kenntnissen".

I think this law is very complex and very hard to convice with Ausländerbehörde although Home Ministry says that A scientist who has special technical knowledge is eligible for Permanent Residence permit under paragraph AufenthG § 19. There is no right though to the granting of a settlement permit; the
decision is at the discretion of the authority (Ausländerbehörde). AB thinks that this law is applicable for Group Leader or Professor or if somebody earns 84K EUR per year.

“Highly qualified” is defined as:
1. scientists with extraordinary qualifications; or
2. Teachers/professors in superior positions order research assistants in superior
positions; or
3. Specialists and management level employees with extra ordinary experience, who
receive an annual salary of EUR 84,000.

Classify yourself into one of the above cadres and talk to Auslanderbehorde. This law doesn't
say anything about language skills or salary constraints for scientists with extraordinary qualifications(Dr.-Ing., Dr.rer.nat., Dr.rer.pol., or Dr.phil.)

Let me know if somebody has got NE according to this law. Ausländerbehörde thinks only Professor or Section Chief is eligible according to this law. I want to get details about this law.

That's very hard to explain, because each officer at the alien office will have his own opinion about it. That's another reason to take the service of our lawyers, because they know the best way to tell them, that you are one of the 'scientists with special knowledge'.
