I have been reading this forum and have a question.. I started working in Germany since Nov 2004 as a GC..

Can I apply for NE right now? Or atleast a permanent working permit?
I am a bit novice with the rules here.. Please help me.

No, unless you have a 84K yearly salary.

you can aply for unlimited IT work permit according to BeschV §46.2

My first "No" was for NE. I just realized that you also ask for a possible permanent work-permit.

This means getting a BE on your limited residence permit. Current GCs usually take advantage of BeschverfV §9 which basicly talks about the people who already work in Germany for 3 and/or 4 years.

Obviously you can not use that. You can try BeschV §46 2. for claiming an unlimited work-permit or BE on your Residence Permit. My interpretation for BeschV §46 2. is that it makes your current work-permit unlimited, but unlimited for the company that is given for. But you can try and see what your ABH thinks about it.

And who has get BE or NE according §46 absatz (2)?!
I have got info that Petrov has got BE (on the 'gute laune der Beamter') but according the LAW text...
Lets see (if come) answer from BMI.
I have kill my self to explain to my Beamter that, and I have no chanches any more even to step in the yard of DES AUSLÄNDERAMT.
He will kill me if I tell him something like that.

max your Beamter is not god and it is not neccessery to pursuade him.
When you want something you ask for it schriftly.
That is the way.
I had quarrel with them also and I reached nothing in talk. I asked one Beamter, he passed me to his boss and he did not agree with me.
But litle bit bigger boss gave me right after Widerspruch.
Those Beamters that disagreed with me still think and do the same but es ist mir egal.
