I will apply for German immigration ( passport ) next year February. My wife is in Germany only for 2.8 years and she will get NE in the middle of the 2012. Now my questions are:

1. Can my wife apply for German immigration ( passport ) with me ?

2. If not, when she will be eligable to get it ?

NO. She should have at least NE before you apply.

After 2 years from the day you change your nationality.

YES she can if he is in germany for 4 years. She does not need NE to apply for Citizenship with you.

As i said she has to be living for 4 years in germany.

I got my citizenship along with my wife and kid. She had no NE.

Thank you for your answer. You mentioned that you, your wife applied together. Does it make any difference if I apply next year and my wife would apply when she completed 4 years ( let say 2011) ? By the way, in which city you are living ? I am living in Hessen ? Do they have same rules and regulation for hessen and other part ?

Why dont you visit the Einbürgerungsamt in your city and ask them directly? You will get better and concrete answers there instead of us discussing the probabilities. I have heard that family members can apply at the same time. I am not sure if there is some special criteria for that.

§ 10 Section (2) says
(2) Der Ehegatte und die minderjährigen Kinder des Ausländers können nach Maßgabe des Absatzes 1 mit eingebürgert werden, auch wenn sie sich noch nicht seit acht Jahren rechtmäßig im Inland aufhalten.

Meaning kids and partner can also apply together and they dont have to fulfill the condition of 8 years
