Hello Siva,

Unfortunately I cannot answer your question to the full, however I can tell you what is important for the Niederlassungserlaubnis. Apparently it depends a bit on who your case officer is, however it is always advantageous to show them a "secure future". So, for example an unlimited contract is a huge advantage and a one year only contract is a disadvantage. Some officers are quite lenient and are okay with a recommendation letter from your boss and a one year contract. In your case, I don't know what happens, but they may see you as a person with unclear future. Again, I think it depends. If you can do that, try to show them some solid contract and not HiWi-like jobs or part-time jobs. If you can't, then I think you have to apply with what you have and maybe you can get a reference letter from your boss. That may improve the situation.

In order to be eligible for an NE under §18b you need a degree from a German university AND must be currently working at a position suitable for someone with a degree (manual labour is not sufficient). 


§ 18b Niederlassungserlaubnis für Absolventen deutscher Hochschulen

Einem Ausländer, der sein Studium an einer staatlichen oder staatlich anerkannten Hochschule oder vergleichbaren Ausbildungseinrichtung im Bundesgebiet erfolgreich abgeschlossen hat, wird eine Niederlassungserlaubnis erteilt, wenn

1. er seit zwei Jahren einen Aufenthaltstitel nach den §§ 18, 18a, 19a oder § 21 besitzt,

2. er einen seinem Abschluss angemessenen Arbeitsplatz innehat,

3. er mindestens 24 Monate Pflichtbeiträge oder freiwillige Beiträge zur gesetzlichen Rentenversicherung geleistet hat oder Aufwendungen für einen Anspruch auf vergleichbare Leistungen einer Versicherungs- oder Versorgungseinrichtung oder eines Versicherungsunternehmens nachweist und

4. die Voraussetzungen des § 9 Absatz 2 Satz 1 Nummer 2 und 4 bis 9 vorliegen; § 9 Absatz 2 Satz 2 bis 6 gilt entsprechend.
