I have question regarding applications for GC due to changes in immigration law since 01.2005.

I got contact and started to work with company in Germany as IT specialist since middle of December. Couple days before that I arrived to Germany with 3-month temporary visa to work and to make application for GC with that company. At that time I already had documents from AA and so on to make application for GC at AuslanderBuro. Due to Christmas holidays, actual application was made in middle of January, one month later. When we was making application, reply from officer was "your application is good but, as new law is applicable from now, you must wait until we figure out how your visa should be done properly". Since middle of January, we are checking every week a response from AuslanderBuro with constantly the same result "please wait we are working". Eventually, my visa expires in middle of March. AB is processing application for month now and it may take longer.

I would appreciate to have information from experienced people regarding GC application with new law if any changes existing. What is usual period of application could be? Should applicant force an application, or whatever? What kind of problems application may rise in this particular case?

I think you are a kind of "rara avis" 50% GC (old law) and 50% "IT Spezialist" (new law).

I´m not a lawyer or specialist, but maybe I´ve heard more things than you.

First of all, I think you and your company have to be calmed because you are here, everibody did the things correctly and at the end you will receive the WP

Second, I think there´s not too much cases like yours, this is the reason for the delay in the application.

The GC regulation was designed to be fast. Some of us taked a week to be processed, in my case, about one month. But this time is (or was) always in the Arbeitsamt (AA). Once the AA brangt the conformity, the papers in the ABH (Ausländeramt) takes 20 minutes.

I think ABH is trying to include you into the new law (personally I found this would not be correct because you started under the old law and any delay was not yours) but if you will be in the new law, maybe is more positive to you, the only "bad thing" is surely you will have to expend some hours in a german language course, but it will be free of charge.

By the way: in which Bundesland are you?

I am in NiederSachsen. I suspect I am first who is making application accordingly to the new law in kreiss where I do live. So they are thinking ...

Its pity that so much time passed away but this question is still unresolved. Its really uncomfortable. I would like hear also from somebody who is in same situation.

I think, the law should have instructions for the case as I described. If any information available about such, please point me.

your Aufenthaltserlaubnisn should be given According to §AufthG 18 and § BeschV 27. You should be given 5 years visa as you have a workpermit of 5 years from AA. That's the experience what I have with similar situation.

You did not saw this SUV because it comes in 2008 (by then we will all have NE).
It is big as BMW X3, meannig smaller and cheaper than ML.

If it's cheaper than the ML, then I'll get my wife that one :-) for real. Wanted to get a ML but it would have taken the hell out of my pocket.

I am also facing the same kind of situation. I am currently in india and we applied for the GC in second week of December. So around January second week me employer got the form from arbeitsamt which was read as "Application for workpermit". They told to fill the form and send it back to arbeitsamt. Me and my employer both filled up the form and sent it back to arbeitsamt it reached there on 25th January but since then we have not heard anything from them.

So we made a call to Arbeitsamt few days back but they told us that they have kept it on hold and they will review our application once they will start with the new law.

@Detlef/VPMK: Can you help us in this regard or can you legally get Arbeitsamt to review our application??

I just finnished a conversation with one of our lawyers, regarding the difficulties with new work permissions. Every polititian said it will be easier with the new law, but fact is, it is much more complicated now.

There is no more guarantee for IT people, that they will get the permission (so called Green Card) and now you, or better your new employer, has to contact the 'Ausländerbehörde' instead of 'Arbeitsamt'. But inside, the AB will ask the AA and there is a big lack of knowledge in both places.

So at least the applicant and the new employer will suffer under these circumstances.

Another point is, that the German embassy in the country of the applicant has to give the first visa, and they are very careful at the moment, not at least because of the political discussion about the so called 'Visa Skandal'.

All together I strongly recommend our Package 3....

it will be cheaper than ML but...
it only comes in 2008. beside it will not be a lot cheaper than ML. it will cost min 30k€ and that means that you can get ML much cheaper.

you can get used ML for 14k€, which I would rather recomend than buying X Klasse for 30k€ after waiting till 2008.

but I would recomend new KIA Sportage or Hyundai Tucson for 18k€ on the first place because they are cheaper in Steuer Versicherung and Verbrauch.

Problem is that they lose value quick so it is better to buy them min 2 years old.
That way you gain instead of lose.
