Has any one claimed the tax return for the financial support of parents who are under 65? My claim was rejected on the basis that my parents are still of working age according to German law. However in my home country the retirement age is 60 which my father has crossed already. How can the German age limit be applied to the person living in another country with a different age limit?

Are their any legal references to counter the rejection from Finanace office?

Before you go into the nitty-gritty of the topic, first thing you should do is to write to FInanzamt countering their rejection. You should know that there is a stipulated maximum period within which you need to do this. Otherwise their rejection would be valid.


Any doubts, call the telephone number on your Steuerbescheid from Finanzamt. Your Sachbearbeiter/case worker should be mentioned there.

Exactly for that purpose I was looking for opinion and information. Would be better if I could counter by refering to some court decision, law or similar cases. I have time until 12th April to write an Einspruch(appeal).

May be you can try out following
1) Submit your father's retirement certificate
2) Submit bank statement which shows pension credit ......

As per german law, if your father have income (pension) less than Euro 624, you definitely can show max upto Euro1920

As far as claiming date is concerned, offcourse you have to claim any rejection within 1 month.... but if not..still you hv possibilty of claiming till 4 yrs (following TAX year)
