LOL. emoticon))) This is kind of never-ending story. The discussions have been postponed AGAIN!!! to Feb. 27. This is a really nice way to deal with a problem... just postpone it maybe somebody with balls would come later on and say YES/NO to your problem. This handling made me laugh indeed. I'm glad I have chosen not to wait for them anymore.
Good luck guys... it's definitely needed.

Yes Florinux

You're right. Another time postpone to february!!

Maybe I'm getting old. I'm tired of indefinitions.

Yes or No but soon. We can't wait forever.

I would like to know any more details, but the informations on TV are only in Teletext, just a brief, not yet in the news.

But I was surprised of the news of a lot of newspapers and even the TV with the surprise of the germans because the immigration rates are going down.

Maybe some immigrants are more clever than us and are choosing another destinations.

Regards and have a good weekend.

Answer

Hi,
I have read so much of immigration, staying, going, this and that...I am Green Card since 10.2000 and I have been trought so much problems that the germans soud make me a monument in the midle of Berlin.
Who ever it may be interested:
Under the AuslG§24 it is clearly explained 5 steps how, why and when you can have an "umberfristeted aufenthalt" in Germany.
So in "auslenderamt", they will never tell you that and they are non-stop telling you since the day you have got in Germany, that you must - GO! ( That is hapening with me)
However, in this law is clearly explained that you can stay more, als long as you want afther the period of 5 year of GC and wether the germans and all world like or not he GC are having same right as all others auslanders from rest of the world.
Also I like to mention that since today I had 4 companies as IT GC and in all 3 previous, I got "kundigung" - kicking off from company from my employer!
Anuway, it is not going just like that...come and sty 5 years and then GO AWAY - WE DO NOT NEED YOU!
I have 36 and after 2 years (my GC is finishing then) when I return in my "fucking" contry Macedonia, they will tell me to make suicide than to come back from Germany. It is impossible just to left all life and go back.
And then...Germans know very well thet all who are comming from NON EU Countries ( and beside Macedonia,Serbia and Albania) all are in EU,and all from rest of the world - that we are not coming from HAVEN and that your lives are not playing exeminations of 5 years and I do not know what else.
I have 2 kids, my son is born hier, and I will fight as much as I can to stay longer.
5 years I am just paying the billings, flats rent, tax, security, moving from one to another town, bills, tax again, bills, this and that...and I have not make any single mustale or problem...so what am I -- WHAT ARE WE ?! If we Green Cards Holders have come to Germany under the law and pharagraps and all law and regulation are obligatory for us, then all other law and pharagraps are with same validity as for all other in Germany...
So abouth the stayuing afther 5 years...YES any can stay according this AuslG§24 pharagraph - unbefristete aufenthalt !
More informations abouth law and regulation..
www.bmi.bund.de - you can find there all laws!
Any friends who want to get in contact with me..I will be happy!

Stefan,

It is very clear here.
Remember the 1960s, 1970s when Germany imported young to midage workforce from countries like Turkey. And currently the number of Turkish population in germany is 6 millions of people.

Greencard regulation is very well shaped and designed:
1- have the foreigners work in germany for 5 years.
2- have them pay taxes like german citizens for the highways, schools etc.that the 5 year limited foreigners who can not get any use of this schoools, highways etc. after their 5 years residency.
3- get them the most/give them the least in this 5 year period.
4- fire'n'hire policy overall, regular GC will show his/her best performance not to be fired, will come to work at 7 leave at 22(thats guarenteed)

what should i say more ?
very good deal.
Congratulations.

Answer

Hello Everyone,

I am really tried to see that everytime the law is being postponed. I had high hopes before but now i think i am tired and desperate. I also somehow feel that most of them are tired and dont even want to discuss on these issues. We somehow feel that soon it is end of the tunnel but no light...

I like this country, culture etc.. My child was born here, i am waiting for an another soon. They will go to german kindergarden. I am still driving with my old car fearing that after 3 years, i will not able to sell a new car. I think 1000 times before i buy even a big TV beacause it is difficult to throw away things.

I was in the US for a month but i never felt good. Life was hectic, Cars are next to god, no peace of mind, you dont feel secure but still all foreigners are happy beacuse they have a bright future. They all know that if you intelligent and honest, you can survive without a scare. In germany, everything is perfect, no junk food, good trains, beautiful landscapes, and you can list 1000 good things about this small country. In the end, what is the use, when we are not certain about our future.

For politicians, we are just a burden. The only sin we did was that we are not EU. But is EU everything? are we not people who pay tax, develop technology, publish scietific papers, promote peace, exchange cultures????

Where will this end? It is no use to make a hunger strike but we can demonstrate by peace. We all should hold our hands and walk in berlin to proove that all holding hands have not comitted crime but developed new technologies for this wonderful contry. Atleast then, they will look for a solution.

Have a nice evening

Regards,
Rajesh

These are really good news.

I really want myself that the Zuwanderung-Gesetz will be denied at 27th February and everyone (like myself) working as GC having their kids born in germany, took their family to here etc. start to learn how the things are really looking like in reality.

I do not believe that other people who are having joy for coming to germany as a GCer will continue to have their willingness after reading these forums for 2 hours.

Honestly speaking I am also currently looking for solutions how to get rid of all these uncertainities and similar things. I am not so sure how people will behave if the law is denied at 27th February.

You guys, do you want to stay in Germany and look for opportunities or will you look for other countries like Canada,UK etc. I really like to know what other members in this forum will behave after things get exact (hopefully) at 27th February.

Regards and thanks for your understanding,

Hi !
I am already thinking about immigrating to another countries like Australia or Canada though I do have a very good job here currently.
I know life is tough and finding job is even difficult (where ever you go). But there is something called HOPE. A hope for a better future for you and for your kids. I don't think the immigration law
will ever pass and I bet my life on it. These politicians want to show that they are "more German" than what any ordinary Germans are.
I know quite a number of asylum seekers who are in Germany since 8-10 years eventhough they are not entitled to it. Surprisingly, they have more than one ways to remain here that too legally.
We so called "Green Card Holders" have been invited by the German government and putting us in the same category as those asylum seekers is the hardest thing for me to digest. Perhaps Germany is and would be a better place only for asylum seekers. It is not for some hard working, skilled and creative people. Thats the only conclusion I could draw out having worked here for more than 3 yrs.

UK Immigration law
Answer

Hi GCs,

I trust 80% of us are not somehow happy in continuing life in Germany. I see lot of GCs applying for Canada/Australia or may be in a stage to apply. ACHTUNG ! Be aware of current situations of these countries, specially considering Job situation. Recently the Canadian Government has announce that all landed or to be landed immigrants are not allowed to travel without their PR card. And now it became 100 years long queue to get a PR card because all immigrants currently working somewhere in the World are now returning to Canada to keep their residence live even without having a job there. 50% of immigrants who are studying at Canadian Universities are finding it difficult to get a job after their study.

Do you know there is also point based immigration, launched recently, to immigrate to UK ? Check at their homeoffice website for elligibility. Also note, after June they will increate the application fee from 150 to 600 GBP. The process is so simple. You will get your UK Workpermit approval within 6 weeks of your application. Then you have 3 months to get entry visa (which is very easy) and after getting the entry visa, you get another 3 months to enter UK. You can even search for jobs before going to UK. Good luck to those who don't know about it yet and will find it very attractive. As job situaitons in UK are at least better than Canada or Australia. GBP is becoming stronger now.

You are also a verry fine analyst of economic data coming from all these countries ... you must spend a lot of times doing this.... May I take your advise about GBP rise as a free tip... I wnat to make some money investing in it...
Sorry for being unpolite ... but I think we have to be more careful when we present our stand point...

Hello Florinux,

Nice to see your polite & matured reply. We are neither fighting here with each other nor throwing stones in dark. May be it was my view-point and I agree these are not documented. I will only say, TIME is the only document we can trust on. May be your experience with PR card is different. I don't know how long before you got it. But if you go now and apply for your PR card, you have to wait for 3 to 4 months for it. And note, I am not discouraging anyone for these countries. Don't take it personal but you should agree that Job situation is not so good there. For you it might look that all my statements are wrong but for me they are correct and I only want to share my view with others. It is not necessary that everybody has same view. Thats the point which makes us sharing our views and experiences here. Good luck.

dilbir, I think you are talking about work permit and not HSMP, for work permit - yes - IT is removed from the shortage list - this means that if you apply for work permit in IT area you need to wait forever to get it, but it has nothing to do with HSMP. HSMP is based on "educational qualifications, work experience, past earnings, your achievement in your chosen field and
your husband's, wife's or unmarried partner's achievements"

Hi all

As you have noticed, HSMP means that only those who are really "Highly skilled migrants" can use this program.

The 40k salary in GBP is just only a part of the point system, the total ammount of steps I guess are about 12 in which are involved age, languaje skill, education, spouse education and over all your professional achievment.

The link is this:

http://www.workpermit.com/uk/hsmp_calculator.htm

I guess the minimum point is 65 to qualify.

You can try and good luck

"after that should I leave to UK immedaitely, or with that visa can I go for a visit and come back to germany as usual and keep searching for the Jobs there."

i am not sure, but i would think you will have to come to England with your visa, apply there for a 1-year-valid residence permit and get some little flat there; theoretically after that nothing can stop you from going back to Germany emoticon

the questions are:
1. whether you will get problems with an application for english residence permit if your german residence permit is not given away. immigration offices do not like such situations as it makes life somewhat harder for them, while they want everything to be plain and simple
2. how much time you are allowed to be absent in England. guess 6 months as well? you would like to check it

anyways, the advantage of HSMP is that you get a 1-year residence permit without having a job there yet. however i would think that you will need to have a job when after a year you will apply for the prolongation

P.S. NE Deutschlands can be revoked as well if you are absent for more than 6 months from Germany and did not live in Germany at least during 15 years already

Something Little about HSMP.

If you happen to get acceptence letter from UK Home Office for HSMP, you dont have to goto England to get 1 year residence permit, instead you get 1 year visa from British Consulate in Dusseldorf.
To extend this 1 year visa you have to show that you were economically active during this year and did not took anything from the public funds. You can goto UK in the ninth month after your visa starts with a job or business and still can get further 3 year extension (Something my 2 friends did).

HSMP allows you to work with any company in UK or start your own business. If you are from Common wealth country you also have the voting rights.

The job stability is low as compared to Germany but the IT market have more job openings than Germany.

Thanks for the Info, this is what I wanted to know, because I want to get the 1 year visa and also with this I want to visit UK for a week or so with my family and then search for a job.I got many calls from UK that they have a job with good pay if i had the permission to work there.

So with this solution u gave works fine for me, and it also acts as a backup if the authorities mess up something with my NE here in Germany which is due early next year.

Any other pointers are welcome

Can someone throw some light on the main differences between Working Holidaymaker Visa and HSMP Visa ?

What I understood is: WHM visa is for Commonwealth country nationals, issued for 1 year, and you are supposed to work for atleast 6 months. Better option for graduates compared to a visiting visa (which is valid for just 6 months and costs almost as much)

HSMP allows you to immigrate to UK for 12 months, after which you can extend your visa to 3 years. At the end of 4 years you will be given Permanent Residence Visa. (No difficulties as in German NE case). A work contract is not a requisite to apply for this visa.

18.How long have I got, after a successful application decision, to enter the UK?

You must apply for entry clearance at a British Embassy within your own country and within 3 months from the date of your approval letter. You must then enter the UK within 3 months of a successful application for entry clearance.

Does the time span restriction of staying outside germany also apply if you get a german citizenship.Like with our GC ...we cannot stay more than 6 months at a stretch abroad.
i do not want to go thru the mess of the HSMP program .Better stay here two more years and smoothly make the transition ...what do u all say?
