Thanks for the reply.

I am not new or fresh buddy to Germany but frankly speaking unfamiliar with NE. I studied and worked in Germany for more than 3 years as mentioned in other thread.

So would defenitely think there is no greedy in finding about the NE.

There is rule you have to go to your embassy and make aplication for NE not in Germany. Good luck!

If you dont have too much time before you start your job, the fastest way would be following:

1. Take normal Arbeitserlaubnis there in India or whereever
2. Come here and apply for NE under para 19 (Highly qualified)

Reason is, if you apply directly for NE, it will take longer time because only the background check in Germany takes about 4 weeks. In case of a normal AE your documents would be sent to Arbeitsamt (takes about 10-20 days depending on which city. Munich is less than 10 days) in Germany but not through this strict security check (Verfassungsschutz)

If you have lets say 2 months + time, I would apply for NE because its a secure title and there is no check from Arbeitsamt. So basically Arbeitsamt checks if there is equivalent German etc for the job and this wont happen in §19 Niederlassungserlaubnis.

One more suggestion if you do decide to apply for NE from India or somewhere, try to get a nice letter from your future company saying why you are highly qualified and why they took you. This always helps to make a strong case.

Outside Germany, any visa to Germany is always a temporary resident permit (90days) which upon arrival needs to be renewed as regular permit.

For NE, its the same.
Moreover for NE as high qualified, one has to prove the salary and a letter from the company why he/she is highly qualified.
I doubt if a company would provide it during the probation and atleast the ABH needs 3 months of payslips ..
so it all makes you to work in the firm for some time and then fulfill the requirements implicitly.

Asking for NE in the birth country would raise eyebrows for the officers at consulate emoticon

Thinking about this, I think it is correct. I didnt think about this.

I think the company will give you a letter without any problem if you tell them cleverly that it will save them work in the future of helping in extensing normal AE.

As far as 3 months payslips is concerned, no you dont need them if you apply in the very beginning. I asked in the AB Munich and they said that the rule is also meant for people who come here new and have no payslips. You need a copy of your contract and something called Arbeitgeberbestätigung which says that you have a permanent job, salary etc.

Yes but a basic condition for getting a permanent residence or actually even workpermmit ist that you have a secured economical background. And here the AB can say that because you are in the probabtion period and we are not sure about it.

I would suggest that you apply for a normal AE, come here and apply for NE ASAP (which converting into regular AE, tell them you want NE and give them all the documents). They will do it if possible.

These things depend a lot on the clerk in the AB, the city etc. We can only speculate how they will react but how it really is, can be understood only here.

Which city are you coming too.

Hi all

I have a question and I was wondering some one can help me. I am living since 2001 in Germany and I in 2006 I got divorced with my German national wife. at that time I applied for a NE but they have told me that now you are divorced so we can not give you a visa, later I told them that I have a daughter and she lives with my ex wife, on that they started asking different papers etc. and I used to get every three months a fictionbescheinigung. now my ex wife moved to Austria with my daughter and my current visa on fictionbescheinigung will end middle of November 2009.

I thought to apply nationality as I thought that with Einburgerung test or integration test I need 7 years and in November of this year it will be 8 years, but I heard from some one that a fictionbescheinigung is not a visa is a kind of Duldung and they do not count this time if you want to apply for a NE or nationality ? is this correct ? What can I do in this case ?

You must contact a lawyer specialising in Auslanderrecht & Familierecht immediately. Since your wife has moved out of germany, i think with duldung, your resident permit is in jeopardy. Act fast.

Thanks for message. I think I should get a lawyer, but can you tell me as I am still not sure that fictionbescheinigung is a duldung too. I heard it but I am not sure its the same thing.

Since you have not given enough information it is difficult to advice you.

How long have you been having the Fiktionsbescheinigung, what is written in it, what was your previous residence permit no?

If you have been in the country since 2001, i am sure you would have been working atleast 5 years. If yes then you can have a NE on your own without taking the family permit into consideration. See if you fulfill the following conditions

I would suggest you to write in www.info4alien.de as well, as you are sure to get more legal advice on this regard. But please give them all the necessary information, starting with all the visas you had from 2001 and as well your family status.

Better consult a lawyer for the visa first, the lawyers know to this forum members are www.vpmk.de

okay I came in November 2001 in Germany and since then I am working, I have paid 60 months Rente, I have a place to live, I passed B1 language course, I passed orientierungkurse test with 100% and I also registered for EB Test and it will be in December 2008, the thing which caused the problem is that although I applied for a NE, the lady in Auslaenderamt keep asking me that do I meet with my daughter, or I should bring OT test, or I should do the language test or bring the B1 certificate etc.

If I read the Law, I think I have all the things except one thing, my current job contract is limited to the end of the year and after that I will get a extension, I think for NE one should have a unlimited job contract ?

Not necessarily. It should be that you are not in Probezeit. Are you frelancer or permanent employee?

That section only says that you have applied for extension or change or visa. what did u have before getting the fictionbescheinigung?

I think they are giving you the run around just to get rid of you. Never heard of getting FB for 2 years without making a decision. Since you are not german and your ex-wife is, they are making problems for you. You have to contact a lawyer asap. I think you have waited too long.

I assumed that too, because every time I went for extension, hoping this time it will decided, they have something new for me.. any way, I am not on so called probezeit.

I had I think aufenthalst title and also a aufenthalts gehnimigung but last one was aufenthaltstitle.

I think you are right, I should contact a lawyer, I thought I will bring all the documents and everything they needed myself and there should not be any problem. I suspected that they jost got a chance when they heard about my divorce, well not everyone is lucky I guess.

Hello All,

I came as a student to Germany in Oct 2003.Later I worked as a full time employee for few months and resigned the job due to which my visa got expired in Oct 2008. I came back to Germany in Jan 2009 on dependent visa. I have applied for NE last month and yesterday I got a letter stating that I had an interrupt in 2008 and they cannot grant me a visa. They mentioned that I can only apply for NE in 2014.
I have already been in Germany for 5 years and cam back in 2 months on dependent visa.Are those 5 years not considered for NE any more??
I am very much worried as I have an offer from a company to work as freelancer but my application got rejected.
Please share your Ideas.
