Residency Permit and WP Rules since 01 Jan 2005

Toggle
Dear All,

I have heard the following:
1) Please note that in Germany, "work permits" are not issued any more. As of 1
January 2005, in Germany "residence permits" are issued which is combination
of a work permit and residence permit. There are two types of residence
permits: Limited residence permit and unlimited residence permit for "highly
qualified".

2) These residence permits will be customer, place and
project specific. E.g. If you obtain a residence permit for a person X to
work, for Tenneco in Edenkoben, you can not send this person to work on
another project with another customer at another place. E.g. if you require
to send this person to Munich, we will have to get approval from Munich
employment office first.

Can somebody verify this?

No, it is quite false, even stupid.
Something there is true but not much.

RP can be binded only to firma, not to place and especcialy not to project. So as long as you do not change company you can work in the same firma everywhere.
Acctually RP can also be completely unbinded.
Lots of us here have it.

True, if you are talking about the number of sticks on your passport. There will be only one stick on your passport and it will be the residence permit binded to a work, which makes residence permit a "work permit" too.

there is always a formality between you or your employer with Arbeitsagentur (Arbeitsamt = office for work permission) for work permission. But finally you will have only one stick on your passport, and this will be given only by Auslaenderbehoerde (Alien Office).

This is a novelty brought by the new Law since 01.01.2005. It eases the formalities.

There are two types of residence
permits: Limited residence permit and unlimited residence permit for "highly qualified".

Limited residence permit is called now Aufenthaltserlaubnis.

Unlimited residence permit is called now Niederlassungserlaubnis. There are 2 types of unlimited residence permit. 1 for normal one ( http://aufenthaltstitel.de/aufenthaltsg.html#9 )and one for "highly qualified" people ( http://aufenthaltstitel.de/aufenthaltsg.html#19 ). "Highly qualified" is not the same as in Greencard. It mostly describes scientists, or people having extraordinary qualifications (e.g. he/she has a very high salary).

2) These residence permits will be customer, place and project specific.

No, it will be company- and/or profession specific mostly. German officials are not interested what project you do, but interested what profession you have (eg. IT) and/or where you are working.

E.g. If you obtain a residence permit for a person X to work, for Tenneco in Edenkoben, you can not send this person to work on another project with another customer at another place. E.g. if you require to send this person to Munich, we will have to get approval from Munich

No you can send the person anywhere, to work with anyone you want, as long as the salary and taxes are paid from the same employer and the employer is happy with that. In this case, a person can work anywhere in the world.

German official don't care how you work in a company. They care about permission to work in a company, that's all.
