Hi all,

This might be a old question for you, but please ,I need some info how to apply for NE §9 with §104 2 .
I came to germany in oct 2001 , studied till August 2004 and then got green card in oct 2004.
According to §104 2 says §9 2 nr 3 and 8 will not be considered, but 5 years stay with workpermit is mandatory( as i understood).
So what is the procedure for applying NE ?
Am I eligible to Apply for NE ?
Have anybody got NE with clause §104 2 without 5years stay with workpermit ? if yes , please share your experiences and procedures ?

You are not eligible for NE with the current law..
If the planned law comes into effect then you will be able to apply in 6-8 months time.. as the new law counts half of the student times for the required time to get the NE..

Is that true? I read it in info4alien when a Moderator said that student time is counted for NE but could not find the exact Section of the law. Can you provide the link?

I couldnt find the latest version of the proposal but I am pretty sure that that part is not changed. Just search for the phrase "zur hälfte" in the document.. (Page 18)
