Looking at the text below, one of my friends applied for Niederlassungserlaubnis. He is in Germany since 2001 and completed 5 years. Ausländerbehörde told that they need to ask Arbeitsamt if he can get Niederlassungserlaubnis or not because he is working with Greencard.

Do they really need a query from Arbeitsamt or is this pure BS ? Thanks!

I am sorry if I am writing this message in wrong window as i could not find from where I have to add new topis - Sorry

I got residance permit as a director of the company in germany. That company was in crisis and in the mean time ownership has been changed. During that span of time my residance permit was expired and I was staying in my home country.

Now the new company owner needs my services at the same conditions of the previous.

Any body can guide me how to get the Residance Permit again to join the comapny.

Director come in self employed category.

Waiting for any once guide line.

How long were you in D how long home?

it is possible to be even self employed depending on time in D.
If you were in D > 3 y and at home < 6 months than it is possible.

By the way, is there a law text or § thing which tells AA query is not needed ? May be BeschVerfV § 16 (2) ?

Or what should be shown to them to tell this is not needed.

At my first case they told me will give me NE - my shit arbeitgeber send them a letter that I am terrorist and they quit.
Second time - they need it from me to finish the probezeit - where the heill in those §9 is written that the probezeit must be finished - it says - sofern er arbeitnemer ist.
Thisrd case - the Beamter coullegue tells me I will get visum for 2 years - and after 1 week my Beamter turn back and give me 1 year visum.
Finaly that letter from Bundesministerium - and who has got something as they answer?
From 10 people only 3-4.
Above all - BeschV 46 - gilt als unbefristete so fort - can some one tlell me the case?!
