As of § 9.4.3:

"die Zeit eines rechtmäßigen Aufenthalts zum Zweck des Studiums oder der Berufsausbildung im Bundesgebiet zur Hälfte."

Now as I showed this statement to the beamter hoping to shortened the duration to get the NE, she made the following arguments to deny the application:

1. 9.2.1 says you need 5 years of Aufenthaltserlaubnis and during study period I had only Aufenthaltsbewelligung.

2. 9.2.3 says it needs minimum payment of 60 months of rente anyway.

Any feedback from you guys, is she right? If this topic is discussed already, please just forward the link.

04.2002-10.2004: Study
11.2004-now: working

If somebody is having 60 months rente that includes study period (consider he paid rente from HiWi jobs (part times in University) aound 2 yrs). and the remaining 3 yrs is full time job.

Then is he eligible for NE?

the residence permit has to be aufenthaltserlaubnis...and not bewilligung...

For Daueraufenthalts EG (better than NE), study time is half counted for 5 years calculation.
On the other side, you may also have to pay 5 years of rente!

As I went through the "§ 9a Erlaubnis zum Daueraufenthalt-EG", it appears that it doesnt include the restriction as to get the NE:

"Only Aufenthaltstitel is required and study time is coutned as half without considering the titel of visa itself."

But a minumum of 60 months rente must be paid anyway, as mk mentioned too.

So it makes sense to apply for a Daueraufenthalt-EG than NE !?
