I am a GC holder since 2002 I will be completing 5 years in march 2007.
I have BE on my pass
I have not paid Rente or taxes for 4+ years,my husband is also a GC but I came here first,I had to leave the job for family reasons (child), currently I am working as 400 Euro job.
Family income Brutto 38 k and I am from India.

My question is :-
1) can I apply for the NE
2) what reason should I give for the 60 months rente clause
3)Do I need to consult a Lawyer

Please help me with your valuable suggestions

60 Renten are not neccessary if you started before 2005. Do this search in Google:
trust7 60 Renten not needed for NE

But to get NE you (or husband) need good salary.
If he is working you can get NE. If not 400€ won't do.

Here is the law paragraph which says 60 months of pension payment is not needed.

One more requirement for the NE is permanent job and mine is a 400 euro basis job,
Can I show my husbands job status (Umbefristet)?

About 60 month rente:
Does this mean that you if you stay 5 years in Germany, you can apply for NE. For me I have completed 3 years as GC and first 2 yrs as a student. During my study I did few time part time job so I can also apply for NE ???.

No.. dotcom was not on a Student residence permit but on a normal residence permit. Therefore she can apply for NE after 5 years, even she does not fulfill the 60 Month pension payment requirement. But in your case, you fail to fulfill the 5 years residence requirement, as the student time is not counted. (with the current law)

For NE you need 5 years Aufenthaltserlaubnis,for students normally it is Aufenthaltsbewilligung which is not counted for the NE

Who says that permanent job is a requirement for NE ?? NE requirement is that your livelihood is secured. You can prove that it is secured through your husband.. and you are done..

It's right that 60 Renten are not neccessary if you started before 2005. BUT you need 5 years of "Aufenthalserlaubnis".

Another option is to apply for D-EG - but for that you need 60 Renten.

I was a student earlier and my status was "Aufenthaltsbewilligung" later when I got GC it changed the status,if that is counted then I already have 6 years in DE.

so on the end you can go for NE now and your husband can get it when he reaches 5 y in D
