Partners of a NE holder is eligible for EG(Erwerbstätig gestattet) from the same day. EG allows a person to work for any company or freelance or even start a company on their own.

Being a partner of a NE holder does not change the requirements of getting NE.. meaning one should fulfill all the conditions except when the person is not working, the NE holder's Arbeit and Financial could be taken into consideration.

Here is the part of the law that would be applicable to your wife

(3) Bei Ehegatten, die in ehelicher Lebensgemeinschaft leben, genügt es, wenn die Voraussetzungen nach Absatz 2 Satz 1 Nr. 3, 5 und 6 durch einen Ehegatten erfüllt werden. Von der Voraussetzung nach Absatz 2 Satz 1 Nr. 3 wird abgesehen, wenn sich der Ausländer in einer Ausbildung befindet, die zu einem anerkannten schulischen oder beruflichen Bildungsabschluss führt. Satz 1 gilt in den Fällen des § 26 Abs. 4 entsprechend.

The day you get your NE take your wifes passport along with you and ask them to change the visa. simple as that

@Garimagaurav - That was the answer for getting the NE for your wife. If she has NE she can ofcourse work.

But she can also work even if she does not have NE..like raj said.

Thanks for your replies.I got NE last week.My wife is also working here from last year.Today my wife went to ABH, the lady there said she cannot get NE as we are here only from last two years and then she said for erwebkeit gestattet she will check.My wife is already working and has two times gone thru arbeitamt approval.Now we are interested that she should be open to job market and should not undergo the repetition of the process.So if we know the law we can ask them.Moreover the lady was asking for german langauge skills means certificate though my wife can speak ok deutsch as of 2 years being in germany.
So this is our issue.If you can guide or clear.

if you are only two years here, I dont think your wife can get NE unless she falls in to the Highly Qualified category. If she is already working and had the approval why do you need to do this again?
