Hi,

i just finished my masters from university in germany, and got a job with Siemens. They told me that my contract will start at beginning of Febraury.

I have couple of questions:
1- Will it be difficult for me to have an arbeitserlaubnis?
2- Will the university years be included as part for the 5 years or 60 months for Permanent residence, according to the new immigration laws?
3- Could the arbeitsamt reject me because they feel that any one else for the EU could do the job?

-> No. The company will look after all the details
regarding the work permit.

2- Will the university years be included as part for the 5 years or 60 months for Permanent residence, according to the new immigration laws?
--> Definitely not. You will need to make
60 months social contribution. Otherwise
every student will be a permanent resident.

3- Could the arbeitsamt reject me because they feel that any one else for the EU could do the job?

--> Chances are very less.

Wrong.
There is 60 Renten condition and 5 years condition.
If he allready paid some Rentenbeiträge then it comes in 60 B.
Some years should also be added in 5 Y, but it is very different from Beamter to Beamter.

they speak about this AufenthG §:

§ 104 Übergangsregelungen
(2) Bei Ausländern, die vor dem 1. Januar 2005 im Besitz einer Aufenthaltserlaubnis oder Aufenthaltsbefugnis sind, ist es bei der Entscheidung über die Erteilung einer Niederlassungserlaubnis hinsichtlich der sprachlichen Kenntnisse nur erforderlich, dass sie sich auf einfache Art in deutscher Sprache mündlich verständigen können. § 9 Abs. 2 Nr. 3 und 8 findet keine Anwendung.

few guys there think that because Bewilligung is not mentioned here, it is not added to 5 years.
but i think it is nonsence. They speak only about deutsch kentnisse there.

Hi,

I have 6 years, 3,5 AE (as GC) and
2,5 as student (ABewilligung). I tried with
old §24 to get permanent residence, because I
have automatically got Arbeitsbewilligung after
these 6 years...Still with remark refering to
my GC visum. Nothing helps, officers
say that it must be 6 years AErlaubnis....
So Bewilligung currently is not even considered.
I am not sure that it will after 1.1.05 emoticon

maybe arbeitberechtigung not bewilligung
it is not true everywhere.
there are some state where it is counted.
lots of people got it.
It could be even worse.
Maybe it does not depend on state but on Beamter
