5 Year Rente Syndrome

Hi All,

This is well know fact (at least in BW) that if you have paid five years rente as full time worker then you are eligible for NE. And they do not count your student time (no matter how much you worked in that time and how much rente you paid). Now the question is what about if you leave Germany? Would they consider student time inclusive in deciding whether to pay you all your contributions now or in your old age? Because the rule is if you leave Germany before five years, all your contributions are returned to you. If you stay more that five years, then you can not get them back... Isn't it complicated? If for NE the student time is not considered then this must also not be considered for rente..

your thoughts??

I have also a question about 60 rente. It is required for NE. Is it also a requirement for applying the citizenship ? In other words…. Is it complementary to have NE first before one could apply for the citizenship after 6-8 years?
Thanks in adavance

I just want to recall your attention to this point.

"If you go to auslanderamt they tell that student time is not considered for NE even though you have worked part time in that time and paid rente...So the question is if someone leaves Germany..would this student time be considered in deciding whether to pay him all his rente contributions or not"

Hi,

I want to correct some of the opinions regarding the 5 years Rente.

It depends on the origin of the country from which the person is, to decide if he gets the Rente money back even after, the person leaves Germnay after 5 Years.

1.The German government has some policy agreements with governments of other countries. If the persons origin is one of the country in the above category then the person will not get the Rente if he leaves Germany after 5 years. But he will get Rente after 65 Years, where evere he lives in the world. Most countries in EU comes under this category

2. If the German government dosent have any such policy agreements with governments of other countries and if the person comes from one of these countries, then he will get his Rente back after 2 years of Leaving Germany, irrespective of the fact how many years Rente he paid (can be less tha 5 or more than 5 years). Most of the Asian countries like India comes under this category.

So just conclude if you get it or not.
