Will I be eligible for NE ( 2 + 3.8 Yrs in Germany).

Hello All,

I have a unique situation here. I came to Germany Feb 2000. By then I was on a normal 1 year Work-Permit which I got extended for another year (Till 2002). All though I was on a regular work-permit, I personally did not pay any tax as the company which i was working did not pay me salary, Instead they pay me the living allowances.

With my normal work-permitt, ending by 2002 Feb, I resigned to my company in India and joined their parent Company in Hamburg with the Green Card.

So techinical sepaking its 5.n years by now that am living in Germany.

2- Years with normal work permit
3.8 years with Green Card.

Question is : Will I be eligible now to apply for NE ?.

Could somebody throw some light pls......

Hello Girish,

The most important requirements to apply for NE are 5 years of Residence Permit(Aufenthaltserlaubnis) and 60 months of pension amount paid to the Govt. pension scheme(bfa). As you mentioned that initially two years of your work was without tax payment, check from the time of Green Card whether your company has paid amount for the pension to the Govt. You can apply for NE only when you fulfil above mentioned both requirements. Moreover you must have basic understandings of German language.

if you search a little bit in this forum for "NE", you will find out that you dont need 60 Rente (Pension contribution) for getting NE.

Do you guys think will it be a worth trying for NE now or later (Feb 2007) ?...

Do i really need to carry 60 month tax proof for getting NE ?.
