Hi out there,

Problem: I ordered eye glasses from a shop near my house over 4 weeks ago. The employee in the shop told me it would take 1 week for the delivery and he would send me a message via mobile when I could pick up my eye glasses. After 2 weeks and no message, I contacted the shop to enquire about the status of the delivery. I was told that the glasses were not yet delivered. After 4 weeks, I send the shop an e-mail telling them that since I hadn't heard anything from them, I assumed that the order could not be placed and therefore officially cancelled the order with the e-mail.

Question: Can the shop hold me responsible for the costs of the glasses (value €1000,-) even though they failed to deliver and I cancelled the order in writing?
