My question is: is it legal to have a Arbeitsmarkchecking in THIS case? I was totally sure it is not legal, because §46.2 BeschV is so clear, but unfortunately there is one precedent in Hessen (hopefully, Beamter error).

no it is not legal. this precedent case in Hessen is hopefully, Beamter error.

even with §9 and Be there is no AMC.
AB will probably send Antrag to AA but AA should do just a small legal check instead if AMC.
