Dependent (Bachelor) visa without A1 level Exam

Hi,

Yesterday i came to know that dependents those who completed Bachelors dont need to pass A1 level Exams to come here. one of my friend (employee of SAP)told me this news. in SAP they have one visa consultancy(Lawyer) they look all these matters.

my question is:
1. any of you know the rule?
2. anybody applied on this rule without A1 level exam?
3. if we apply on this rule (our own without any lawyer) is it a problem?

If u r willing to risk delay in visa processing by 3-6 months, then i think u should take this chance.

What fun when no risk is involved ;), after all coming to Germany and opting not to take language courses might be a great idea too.Goodluck.

Depends on the way you interpret law. SAP lawyer interprets that a degree is good enough.
Possibly, the ABH in their jurisdiction thinks the same. The German official in some other place might think that is not enough.

It is the ABH official who takes a decision on it. If they decide German course is required, it has to be done. Unless, you want to fight it out in court of law for a correct interpretation of the law. This would add more delay. It is difficult to convince the consulate officials, that there was a earlier precedent (SAP case).

Anyways, they need A1 certificate even for renewal of residence.

The following applicants are exempted from this requirement:
1) Spouses of refugees, guest scientists, visiting scholars and highly qualified specialists holding an
unlimited residence permit according to § 19 AufenthG (“Niederlassungserlaubnis”).
2) Spouses of citizens of the European Union, Australia, Israel, Japan, Canada, Republic of Korea, New
Zealand and USA. Please be advised that spouses of German Citizens are not exempted.
3) Spouses of citizens who live in Germany on a temporary basis only. It is supposed that theses couples
have a minor need for integration into German society due to their temporary stay in Germany.
4) Spouses who are physically or mentally handicapped or a suffering from any other mental disease or
handicap.
5) Spouses holding an academic degree of a well known, internationally recognized university themselves.

you can provide any one supporting document for the above ,also in the personal letter mention that your wife is very much interested in learning the language and try your luck.

I am a German spouse and I submitted my residence application last week. I don't have a A1 certificate but I have a Bachelor diploma and they accept my application. The ABH told my husband that when i come to Germany, I must take an integration course within 1 year or else i will be out in Germany.
