Work Permit before completing studies

Hello All,

My girl friend is doing Phd here in German university. Her contract with uni ends soon, but she not yet completed her phd. Between she has found a new Job and terminated her contract with uni. But now AHB says it is a problem to issue a work permit because she has not completed her studies as she came here for studies.!! Is it so??

I thought Phd is considered as employment at the uni as its called Wissenschaftlicher Mitarbeiter. Isn't it?.

Can any one give advice on this. Any law which says one can get (or can't get) a permit without completing studies.
