Hi, I was in Auslaenderbehoerde to transfer my visa from old to new passport...10 euro paid :-). And I did asked about the PR. Here is what they say.

1. With the new law I can apply for the PR but it does not ensure your application will be succesful and it cost 200 euro. Some pre-requisite to ensure the success are 64k (double of normal saxony's wages) or more per year or you are realy realy specialist. She said if you are really specialist, you should earn more than 64 k.

2. Or you wait for 5 years...(I still have 10 months to go emoticon ).

I guess I have to wait.

Are u sure is it 64? Cause, it law it asks for 84

according to her, 84k is where you are high qualified person and hold position of director and so on. 64k if you are qualified (such as IT person. 64 k is the double of normal wages in sachsen and 84 k is double of salary of mininum private health insurance

the 84k is a law and the 64k is a regulation in Sachsen.

I had a certain steriotype about eastern German states . But if the info from that lady is official that will change it :-) .
Probably they are attracting IT people ??

Does any body know how is the "normal salary" calculated ?

What the lady said is not ok ! One should get PR if one meets the requirements which are defined by the law. There are 8-9 requirements to meet.

If somebody speaks like that on Balkans, then it means that you should bring him money or bottle of brandy next time and you get your job done. I however still did not get it what this should mean in Germany ? You pay 200 Euro, but maybe you will not get the PR. Of course, you will not get it if you do not meet the requirements, but everybody should know this before he applies, or not ?

§ 19 Niederlassungserlaubnis für Hochqualifizierte

(1) Einem hoch qualifizierten Ausländer kann in besonderen Fällen eine Niederlassungserlaubnis erteilt werden, wenn die Bundesagentur für Arbeit nach § 39 zugestimmt hat oder durch Rechtsverordnung nach § 42 oder zwischenstaatliche Vereinbarung bestimmt ist, dass die Niederlassungserlaubnis ohne Zustimmung der Bundesagentur für Arbeit nach § 39 erteilt werden kann und die Annahme gerechtfertigt ist, dass die Integration in die Lebensverhältnisse der Bundesrepublik Deutschland und die Sicherung des Lebensunterhalts ohne staatliche Hilfe gewährleistet sind. Die Landesregierung kann bestimmen, dass die Erteilung der Niederlassungserlaubnis nach Satz 1 der Zustimmung der obersten Landesbehörde oder einer von ihr bestimmten Stelle bedarf.

(2) Hoch qualifiziert nach Absatz 1 sind insbesondere

1. Wissenschaftler mit besonderen fachlichen Kenntnissen,
2. Lehrpersonen in herausgehobener Funktion oder wissenschaftliche Mitarbeiter in herausgehobener Funktion oder
3. Spezialisten und leitende Angestellte mit besonderer Berufserfahrung, die ein Gehalt in Höhe von mindestens dem Doppelten der Beitragsbemessungsgrenze der gesetzlichen Krankenversicherung erhalten.

An Gebühren sind zu erheben
1. für die Erteilung einer Niederlassungserlaubnis für Hochqualifizierte (§ 19 Abs. 1 des Aufenthaltsgesetzes) 200 Euro,
2. für die Erteilung einer Niederlassungserlaubnis zur Ausübung einer selbständigen Tätigkeit (§ 21 Abs. 4 des Aufenthaltsgesetzes) 150 Euro,
3. für die Erteilung einer Niederlassungserlaubnis in allen übrigen Fällen 85 Euro.

hi all
last week i was also somehow in Dresden auslaenderbehoerde (to get an invitation letter for my brother) when i asked the person for permanent residence ship after 5 years and his answer was that if i am really qualifed and earning more than 64k then i can apply for unlimited visa any time but i am not guaranteed that after 5 years of working i will be guaranteed an unbfristet visa or not. it may oor may nor be possible :-(

he also told me that they have some specialist for this reason in room 160 and i should go there and ask my questions. lets see when i will have time to go again and ask it from people who are specialized in immigration stuff at auslaenderbehoerde :-)

Hi Senkiang

I am also planning to get a new passport from my emabssy and then get a new visa. could you please tell me

1. did you applied for 10 months or you applied for unlimited one or what?

2. your new visa is valid upto which date ? is it limited to 5 years from your day of arrival or bounded with you passport end date.

I think they are right with 64k. I supose that rule is valid there becuse those lands accepted it allthough it is not valid in other parts of Germany.
It is actually normal. It was allways so that some Bundes lands are better for Ausländers than others(than Bayern z.B.).

My company will change name and integrate with one other company so I called AB to ask what I have to do.

Lady in AB said that I do not have to change anything if I give them some paper about changes which I did.

Then I asked what will happen in October (full 5 years at that moment) and she asked me do I want to stay and when I said yes she told me to come in September to finish all papers.

She did not mentioned any limitations except that by new law I will have right to decide will I stay or not.

Sorry she mentioned that I need to have a job.

Btw. I live in Ettlingen next to Karlsruhe (Baden-Würt.).

Yes after 5 years you have the right to get PR....of course with pre-requsites that you can speak basic german.....paid 60 months pension/social insurance...and all other papers work.
