Hello,
I changed my job and get a new residence permit on begining of October, but my wife didn't update here residence until now because she was in home country (she spent there less that 6 months). When we try to do the administrative procedure, authorities said that she entered Germany illegally since here residence expires with the old employement.
Could you help me if it's possible to convince them to do the update or she need to return to home country to start the procedure from begining.

My god, what do they want. Should one GC send his wife and kids home for few months when he changes the job. And wht if kids go to school.
Should they stop the school and go home for few months and then loose year like worst delinquents.
IDIOTS.

You can do only one thing. Get a lawyer.

Yes, lots of idiots sitting there as beamters they don't even bother to explain the things. I would say most of them are experts in saying Yeah or Nein.

Let me tell my experience, I still keep my green card and not converted as dependent of my wife ( she is also GC) I went and asked them 2 different times for conversion but they said it is not required despite i told them that i am not working at present!!.

But seeing your problem, me also illegally lived 1.5 years in Germany. Also i feel much happy being in UK.

some of them are not even able to say yes or no.
Because of that they made a very usefull specialization. They became experts in saying
"I don't know".

Actually I have very god idea how to make use of such a useless Beamters. You should divide them according to words they are able to learn and arange them in apropriate offices. In one office should be placed all beamters that have lot of practise in saying NO and for people convenience there should be written big NO on the door.
Same goes for YES and DON'T KNOW.
That way everyone could choose apropriate office and get all the information he needs in such a short time. In that situation even usually useless Beamters could help a lot. That way Beamters would be really relaxed because they do not need to think any more or even learn foreign languages. In fact it would be as if they really speak all foreign languages allready.
One should only ask the question on any language and Beamter just has to use his knowledge meaning this one word that he is expert for. They do not have to be afraid of making mistake any more. They could give answers so quick that efficiency would raise immensely.
Maybe it could be managable that one answer goes for all questions that one or more people ask. There would be no need to learn law any more. Even if the law changes they would still be experts in what they do.
Everybody would be happy.
I have even better idea. Perhaps somebody could make simple robot that says one of those words and place it in beamters office.
That way Beamter could go and play golf during his work hours. That is even better solution.

If some problem arises Beamter can allways say "I did not say anything" and blame robot for all mistakes.

Thanks for your answers, i give my case to a siemens dependent company specialized in rellocation, and i will know everything next week, i hope good news, especially that my wife is pregnent on 8 months, and she is unable to fly back at the moment!!

If lawyer is good you could even try to get some money for disturbing your wife during pregnancy.
Btw I also changed company but my wife's visa stayed the same because my visa is not binded to company.

I think even in your case your wife's visa should be binded to your new visa automaticaly.
What exactly is written in your wife's visa?

Its really surprising to know this story. I have had both kind of situations in the past i.e. I had visa where my company name was written and I had visa where no company name was written. Due to some reasons I had to change 3 companies in the past 4 years *BUT* I never had to change my wife's visa and nobody asked me also to do so. My wife still has the same visa which she got first time after coming to Germany. And since then I have shifted my company and she has also travelled out of Germany several times. But we never faced such problem of *ILLEGAL ENTRY INTO GERMANY*. Same holds true for some of my other friends also.
Point to be noted here is that in Spouse's visa the company name is never written(atleast in the cases which I know). So what is the need to get a new visa when the partner changes his/her job to some other company?
I personally think that German govt. should form a central Training center for all the (new and old) employees of AB and Arbeitsamt where *SAME* set of rules should be delivered to all of them. I know it is difficult but it is possible and will make the life easier for the future for all foreigners.

Soni your idea is nice but too complicated for Beamters. I find my idea (look above) much more convenient for them.

sorry to Contradict, in my case my wife has got company(in which I am working) name on her visa(in which I am working).

Ironically I don't it on my visa :-)
