No Niederlassungserlaubnis for a 6 years "Aufenthaltserlaubnis" holder!

I am wondering if there is anyone else who has the similar situation.

For almost 6 years, I have worked in Germany: 3 years as scientist, almost 3 years as GC holder. That means all the time I have a "Aufenthaltserlaubnis". As written both in old and new law, people like me could apply a "unbefristete Aufenthaltserlaubnis" or so-called now "Niederlasungserlaubnis" after 5 years. Yes, I tried. But our "Ausländeramt" always refused me, only because my present GC still works! They said they will not consider my case only after my GC is expired. I feel it is a kind of unfair. Why should I have to wait for 8 years, but others only need 5 years? Is there any idea? Can a lawyer help me out?

Hi neko i nesto,
there is really no problem.
Such a answer is not wasserdicht.
What you have to do I do not know in details but once at AA I raised Widerspruch and it was accepted.
So I supose you can do the same. You should make Antrag auf NE schriftly and than Widerspruch and if it doeas not help you can raise Klage.

As far law is concerned you can not lose.
But if you had ABW for first 3 years than you don't stand a chance.
Beside, you can get first step help from Detlef.
That way you will have chance to decide will you use them to pursue NE or not.
