It is quite possible. i have become GC-Freelancer recently. A friend of mine has been GC-Freelancer for an year almost.

The thing to get the status is that all IHK, AB & Arbeitsamt should be convinced.

Can somebody answer my question?
what are the eligibility criteria to be Highly Qualified for an GC-Freelancer?

for e.g.
i have the following lines in my residence permit.

"Unselbstaendige Erwerbstaetigkeit nicht gestattet. Gestattet ist folgende selbstaendige bzw. vergleichbare unselbstaendige Erwerbstaetigkeit: Taetigkeit also freiberuflicher IT-Berater in Duesseldorf."

How did you get this on your passport ? Did you have to prepare a "Business Plan" ? usually as freelancer, you dont need a business-plan, you will just work in different projects of different companies. Do they accept this(IHK, arbeitsamt) ?

That would be nice, if you could share the exact procedure you have followed to get the above mentioned statement on your passport ?

i did not create any business plan. i was only required to provide the contract(s) from the companies including hourly/monthly rate.

i went through an agent, who did the work to convince IHK, AB & Arbeitsamt.

i guess, trust7 can also provide similar services. Detlef is aware of my case.

btw, any more info regarding the highly qualified requirements for GC-Freelancers?

Actually i am free.
they mentioned "in Duesseldorf" just for the info that the IHK of Duesseldorf approved my freelancing.

And AB has acknowledged that i can work anywhere in germany with any no. of clients.

It's interesting to know do you realy work as freelancer. Are you able to find projects? Because, without projects, the stamp in your passport is only a stamp - nothing more.

I am here in Germany for more than 64 months in that I was a student for 14 months and since then I am GC.my GC runs out in Aug'05.The strange thing is in my Arbeitserlaubnis the End date says 'unbefristet'.So only visum will expire in Aug'05.As a GC I have paid Rente for 50 months and as a student I contributed for about 12 months.
Can I apply for the PR now or should I wait till next year.Incase if I apply now whom should I contact first Arbeitsamt or the Ausländerbehorde.
Suggestions for you people will help me alot.

I think you could aply now, but i doubt they will decide before 1.1.
However Studium time is counted, but maybe not completely.

Hi Man

As far as I know, the regulation is quite clear, at least in your case.

Surely you are not a Professor. Maybe if you were a PhD you could fight a little bit. You cannot claim you are a researcher. For that you must have any paper or title elsewhere saying you were researcher before comming to Germany.

The other option could be working as researcher, but I don´t think a consultant will be considered researcher, because I think for a researcher option you must be working or in a Research Center or have elsewhere in your contract or in your vissum the "Researcher" or "Entwickler" or "Entwicklung" (latest modification or VwV).

So, the only way to prove you are really an expert if for your loan. In this point you fall in the 84k category and the only way to prove it is for your Steuerkarte. Otherwise you´ll go to jail for tax fraud, for instance if you claim you are receiving more money that you can show in your taxes.

I believe firmly this thread are going to anywhere and will be a very good idea if you are near the 84k frontier to pay at least the 110 eur to the first consult to the lawyers of the forum to extinguish all your questions.

To end, in my personal case, I was a certified researcher in my country (category granted by the national government), in my contract is the word "Entwickler" and I don´t think even remotely they will assign me a PR because my company is quite small, they do not research anything and not receive any government money.

Why you think you will be considered "High Qualified" apart from your earnings?

For me is absolute clear is Scientist/Enwickler OR money. But in his case is only money!

But i wanted to know whether my case will be considered at all within the section "§ 19 Niederlassungserlaubnis für Hochqualifizierte"
since there is another separate section "§ 21 Selbständige Tätigkeit" for self-employed.

I´m not sure and have not too much time to check, but "Selbständige ...Dinge" is for people interested in open bussines in Germany and you need about 1 million Euro + I guess +10 work places for germans.

My opinion: forget everything, if you can prove you have earned 84k focus in this thing and That´s all folks

Just one more question to more clarify the issue of 84K euro. Does anybody know if a valid a true work contract with a yearly salary of 84K euro will be enough, or one has to wait until the end of the year to prove what was really paid?

To Wael: please, think twice.

I am not an ABH Beamter, but surely the paperstuff won´t be instantaneous. Maybe they will accept your contract with > 84K, but nobody borned yesterday. All the information will be checked and crosschecked more than twice. You also live here and you know how the things works.

it will be checked, but after getting NE, you can lose job, you can get smaller salary, but NE stays.

btw it is impossible that they wait one year to give you NE. there is legaly allowed time to issue Visum, maybe two months and inside this period they have to decide.

Both of your answres (YO1 and DvD) seem to have some sence behind, and that's why I am asking this question.
I hope that by the first feww weeks of January 2005 we will be able to share our experiences through these forums. The main problem is that one sometimes has to decide some plans and they need to be based on facts to minimise any possible risk, it seems to be difficult to achieve that now!!
