Back from the courts... End of the story

Toggle
Yeah, I'm back from there, in fact, the ex-employer couldn't say a lot about the whole thing and the real reason for me being kicked out is still not known, but I don't care anymore.

They have 14 days to pay some 5 figures money to me and the story will be over.

Back to a new life now.

@NoBody

Best part is, apart from your 5-figure golden handshake, you will be paid your full salary till today.

Isn't it great that your boss has given you 2 months paid vacation to complot with lawyers and sue him :-)

Best part is, apart from your 5-figure golden handshake, you will be paid your full salary till today, that's not how it goes, even if that's what most people think: they don't pay the full salary, but the difference of salary, benefits. Let me explain.
You got fired, by the time you were fired, you were earning netto 2500 euros.
You report to AA and then sue your employer.
For the time the trial will last, things will go like this:
- you didn't found a job and thus are receiving ALG, let's say 1500 per month. Until the day the case will be over, the company will have to pay you the (2500-1500) = 1000 euros * months of case, which makes the difference between the 2 "salaries" you've received.
- you find a job and in the new job, you earn less than the previous job, then the company will also pay the difference like the case above (it has to be notified, that when you receive ALG, AA is like an employer to you).
- you find a job and in the new job, you earn more than the previous job, then the company will have to pay you nothing, as the difference is in your favor.

So that's how it goes per law (don't ask me the article of the law talking about that).

@NoBody

I didn't know that, thanks for the explaination. I always thought that Arbeitgeber pays your full salary when you take him to court :-)

Anyway you have been paid full salary, regardless of who paid :-)
