Dear Trust7 members,

I need your help in deciding whether I would be eligible to apply for NE according to §104 clause.

I came to Germany from India on IT green card scheme on May 2004. I applied for AE during July 2004.

Due to change of wohnung anmeldung from one city to another city, there was delay in issuance of AE (may be due to burocracy). I got AE for the first time on 10th Jan 2005.

Please giude me will I able to claim for applying for NE according to §104 clause.

Hope that senior members of this forum will provide useful feedback.

Did you work from May/July 2004 or Januar 2005?
If you came to Germany with this entrance visa in 2004 then §104 is valid for you.

But entrance visa lasts only 3 months!!!
What AE did you have after first 3 months???

Thanks for your reply.

I entered Germany on May 2004 and I did antrag for AE during July 2004.

As i said, due to change of wohnung anmeldung and transfer of file physically from one city to another city I took long time.

After expiry of 3 months entrance visa, I was issued visa on paper (antrag paper). Sticker visa AE was pasted on my passport on 10.01.2005.


Kindly post your best advice in this matter.

§104 should be valid for you, but looks like your ABH did lots of mistakes. Is it some village, cos it is unusual that ABH does not know that 3 month visa should be exchanged in normal few years visa before 3 months expire.

And this AE on paper???

Thanks dear for your advice.

Yes, I do agree with you.

The ABH was Mainz in Hessen.

The visa officer was very slow in response and told that it takes time for physical movement of file from one stadt to another stadt.
