Is there any rule stating, when to apply for NE. Is it only possible on the day one completes 5 years. Our Auslanderamt says so? But I read from this site, it is possible before 3 months.

I applied for my NE 4 weeks before my 5 years. It took full 8 weeks to be processed. After 4 weeks of applying I was informed to go for german language test. There is an another department called Integration where they conduct german language test. The test was only oral and lasted 20 minutes. So my advice would be to brush up your german skills before going for test.

well it differs from place to place and people to people .. i got my NE in a month after application and there was no Language test or any thing of that sort.

You are right, a GC friend of mine applied to same ABH and got it in 1 month without any german test :-)

according to law you really need FULL 5 YEARS from ENTRANCE in D.
not from start of visa but from a first flight day

they can issua NE litle bit earlier but if law is strictly folowed than it is last day or later.

you can get short extension or Fiktionsbescheinigung. just ask

Fiktionsbescheinigung will cost you 30€ and 2 years extension 40€ :-)

Do they keep your passport with them during this time? I would like to apply for a NE, but I have to do a lot of travelling for my work.

In my case I applied 4 months before the 5 years end ,since than elapsed 5 months and still no answer (hessen)

Haha if you do something like that they can say that you applied too late and therefore can get only a prolongation of your AE for a time being.

send them your application through registered mail, enclose all necessary documents and write there that you apply for NE from the date when your current residence permit will expire and that you will submit the other documents as well if they need them and will inform you about it.

that way they would not be able to say that it's your fault that you applied for NE too late. if they still will insist that the application has to be made on the last day, you will at least have the written answer that will allow you to claim damages if they will find out later that they actually need more time for processing of your application.

not exactly, i for example do not have any from year 2002 and do not have any problems at all. the officials have lots of them

I am in a similar situation.
My GC ends in october.I visited the Auslanderamt last month(i.e. 3 month before the end of GC) for NE.They gave me the NE application form and asked me to come in october on the last day of the GC.

I asked them if that is not too late. They said they can not give me NE before the GC end date(5 years in germany)

I also asked them how much time would it take if i come on the last date, for which they said "immediately". They kept the letter from my employer which says that i have unlimited work in germany.
Now I am worried what if they find some problem in my application?

It is not a problem to go exactly one day before your GC expires. They are right while saying that because they need to check whether all the documents are correct and your oral language skills and this needs around 30 minutes.

Normally it takes many weeks because of the security check and some beamters put you in the list without having to submit your NE application. Important is to clarify & confirm with the beamter whether they already put you in the security check so it is important to visit foreign office one month before to see how beamter agree on your application.

So far, I have heard about, it is 4-8 weeks in advance that you will have to apply for NE. I also had a same situation, that I too went 3 months in advance. But ABH asked me to apply 4 weeks earlier. And they gave me a Fictionbescheinigung (kind of extention for 3 months from the day of submitting application.) It took 7 weeks in my case to get NE.

I would suggest you to go again to ABH one month advance. Going at last day seems to me bit risky.

I specifically asked to ABH employee if i should come one month before the end of my GC. She said it is not at all required and i must come on the last day.

But in my case she kept (only) the letter given to me by my employer stating about my unlimited work in germay.

She told me that there is some document required from Arbeitsamt about me which she would get. I am sure if she would start the process of getting that document when i visit her OR she has already started it.

Does anybody know whats happening??

Mein GC ends on 30.08.06, and I entered germany on 03.09.01, got Aufenthaltserlaubnis on 10.09.01.

That means I stayed in germany 3 days less than 5 years, and processed AE 10 days less than 5 years.

I have already a unlimited contract.

Is it possible for me to get NE now?

I entered in Germany in October 2000 and got my NE in August 2005 (damn, nearly a year now, time is going fast...), so I got my NE 2 months before accomplishing my 5 years in Germany, so your case should be normally handled.

I have called the Alien Office to get an appointment. They told me I can only go on 04.09.06 because no earlier appointment is available.

I ask him if it is ok I have no valid Aufenhaltserlaubnis from 31.08.06 to 03.09.06. He told me there is no problem at all because I have made an appointment in time.

Could you please give me an advice if I can get a temperory paper, at lease for my employer?

heh if they are going to reject your application or make some "shit", you will be a fool. because you have to apply for a new AE (not just to make an appointment) BEFORE your old AE expires, otherwise you will not be eligible to work anymore.
