Limit to stay outside germany for a baby

Hello ,

I want to know, for how long a baby ( German Born ) with Indian nationality can stay outside Germany so that all the conditions should be fulfilled for German citizenship later. Baby is now 1.5 Years old.

I have NE. I want to send my baby to India for some time. Can I send baby for 4 - 5 months ?

I will appreciate all of yours quick help.

Hi Adi,

With a valid resident permit in Germany. I believe the child ór adult can stay for a maximum of 6 months outside Germany.

If you want more then you got to go the Foreign Office and request for the same.

This is purely my opinion. Hope others can provide their input.

Your baby can stay maximum 6 months in one year outside Germany.

As you want to send him for 4 to 5 months, it should be fine.

i also think its 6 months if ur child also has same staus like u.
please confirm from ur local authority.
If not then its 3 months.Others can put inputs

I too did not understand the link between baby and citizenship.
What kind of Visa does your baby have now?
If it is AE then i think your baby cannot stay more than 6 months.
If it is NE then it is not more than 12 months.

Experts correct me if i am wrong.

When will your baby be eligible for DE Citizenship?

I have NE, but my baby has AE . By citizenship, I mean, as baby is Germany born. Then after 8 years baby will get citizenship or may be even before.

So there should not be problem due to staying outside Germany during that time.

With a normal AE or even an NE, one can stay outside Germany for not more than 6 months in any given year. This rule applies to one and all, regardless of one's age.

Coming to your question about this affecting your child's EB application. This would not affect the application whatsoever as long as the above rule is followed.

A child cannot get citizenship on its own until it turns 16 here in Germany. That's exactly when he/she can apply for EB and not before that.

8 years of continuous stay in Germany applies to adolescents and not children, hence your child can only get EB if you apply for one.

So upto 6 months in a year is no problem to stay in India. Will it affect the kindergeld during that time ?

Your son can get citizenship if one of the parents has german citizenship.

Kindergeld is automatically transfered to your bank account so there should not be problem.
