Finally i had a talk with Bfa people after my 2 year. I have sent my application(v400) to them and they requested me to send my Passport(Auswies) with my picture in it and validity should appear in your passport and a request letter stating that you need your money in your Checking account or Savings account like that.

Till now this is the main requirement. If any thing comes up, i will post you soon... but i don't think they need more...

I was working in germany on green card for 61 months then left. Now i have come back to work for 4 month project after 1 year, but my salary is paid in my home country. Do you think my waiting period of 2 year will start again or these 4 months will be included. I have done registration to town authorities and they have my passport for residance permit. but i was not issued any tax card.

Hi Jose,
if you pay tax to german government, yes then your 2 year period will start from the month when you stop paying taxes in germany. If your salary is paid in your home country, then you don't pay taxes in germany and your months in germany will not be included for your pension fund.

pension fund refund claim depends on which country you come from. Most of the 2.wc you can claim even if you have worked over 60 months. so which country are your from?. there is also a country list on Bfa website.

I called the Bfa people few days before and they told me that I can get the money back only after my retirement as I have worked here for more than 60 months.

This is also happened with one of my friend. She consulted one lawyer for this but got the same reply from the Bfa people that she won't get money back as she worked in Germany for more than 60 months.

Hey, I am sure if you are from India, even though you worked over 60 months , you will be able to claim it after 2 years you leave De. Here is the list of countries who cannot claim before age of 65.

I am also currently in a kinda similar situation. I worked in Germany for 3 years and then moved to USA. I took 2 years mutterschafts urlaub. Which ended last month. I spoke to BFA (on line chat feature where you can chat with rep from BFA)and they said his you have stopped contributing to the pension fund 2 years back you can apply for getting your part of pension back.

Are you in USA too. What all did you do to apply for getting back your pension back being in the USA. Is form called v900

You need to send the following documents

1. V900 Bundesversicherungsanstalt Fur Angestellte.
2. Your passport copy(with your picture, Visa Validity, your personal details)
3. Your bank details (mention your account type, i mean checking or savings etc) in your letter.
4. If possible abmeldung letter(unregisteration letter).

regading 60 months +... there was a clause, you may not get if you work more than 60 months... you will get only after 60 or 65 years, even for India.

Correction!!! I was in Germany for more than 6 years but initially i was an Indian Employee, I used to get salary from India!!! Hope this clears your doubts... I paid taxes to Germany for about 59 months i think... but i know it is less than 60 months!!! Hence i moved out from Germany(don't blame!!!)...

You know lots of people in USA also do this, i mean once they get their Citizenship they are moving out after 10 years of work(means you have had contributed for Pension plan, ie., 401 k etc) in USA, to get pension (about $2500 per month). You know it's a lot of money if you do this way... and that to $2500 US Dollors is huge money in India!!!

When i enquired in 2005 with BfA about Pension refund for Indian citizens after completion of 60 months, i had been informed that it is possible to get a refund after 2 years of leaving Deutschland.

Even i was in confusion... Since i heard that there is no restriction for some nations like Indians... I met the Manager in Bfa, Karlsruhe and he mentioned clearly that after 60 months of work there is no-way to claim our pension before 65 or 60 years of age... no idea, why some people were telling it is possible for some nations and some were telling not possible... you can contact Bfa... you will receive 2 or more answers for same question...

Before i leave i have clearly asked the Bfa manager...

Contact them and get the details... even i would love to know more... I am not changing the law, but those words are from Bfa Manager, Karlsruhe.

I have a question for you. After you left the Germany also you got your Muttersaft Geld(whatever it is). But you are eligible to apply your pension refund after 2 yrs which is correct, but what about the Muttersafts geld, you may have to cross check with Bfa or whoever concerned... since Once you left the Germany you are not supposed to get any money other than your pension refund... they may deduct Muttersafts geld from your pension refund... just check this... as i have had discussed same about my kids Kindergeld... after i left Germany i have had informed to Arbeitsamt about kindergeld, as we left we are not suppose to get this money!!! But not sure in case!!!

For India and lot of other countries which donot have an agreement with Germany to transfer our pension from Germany to that country, you can work any number of months and get your pension as a total refund (your part, not what your employer paid) after 2 years. But in case you want to transfer it to the USA, you need to move outta here before 5 years are over.

Actually this was discussed 100 times here, and our FAQ does mention about it too.

This is 100% true as I checked with BFA Munich last week.

Whatever experience i had with Bfa, Berlin i wrote... i am not arguing!!! As per Bfa, Berlin i was told that i will be receiving my pension refund in 2 months. I am no where concerned with FAQs. I need my things to be done... thats it!

Today again i had a talk with Bfa, Berlin and they said there is no problem even if i give USA bank account or any country bank account(as they said). It will come to your bank in 2 to 3 months approximately. I have clearly mentioned in my tele talk if there is a problem i am going to change my India bank!!! They said it is not required...

Thanks for putting the facts straight.

I had to comment because it was mentioned here that 60 month rules also applies for Indians. I was told differntly from BfA some years back and i was wondering if there is a change in rule.
Some times it helps to discuss the matter again because the rules may change and we may not know it.

After rereading the post of sweetyb in this thread i am wondering why sweetyb and her friend got a negative reply from BfA.
She also mentioned that some of her friends got the money even though they worked for more than 60 months.
Sweetyb could you please tell which place or State you got the negative reply from BfA ?

Maybe someone would want to settle permanently in the USA, or maybe he wants to continue to grow his retirement corpus? Who knows?
Anyway for Indians its better to get the refund as a lump-sum, as we are not going to live till 90 or 100 anyway!

Good news... I got my pension refund yesterday... i can see the amount in my bank account(USA Bank) within a month... applied on 25th Dec 2006 but they asked for couple of documents from me... i have sent them through email and also faxed them and contacted them to reconfirm whether they have received or not... and i had very friendly conversation with Bfa, Berlin(talked to them 3 times to move fast)... Finally things were done within a month...

* Did you apply for refund after 2 years from the date you left Germany? Or at the time when you left Germany?
* Did you send your application form directly to Bfa, Berlin office or through German Embassy office in US?
* What other documents you needed to send to Bfa besides main application form(you mentioned that they asked you some additional docs)?

You need to send the following documents...

1. V900 Applicatin form
2. Personal Passport first page (your photo, Date of birth and passport expiration date should appear).
3. Your bank details (letter would be good, mention the account details and mainly Savings or Checking account).
4. Abmeldung form(once you left germany you need to unregister your address etc).
5. Send all the above documents to the mentioned address on V900 form through courier with Tracking number for your records, if possible call them over phone... after 1 week or 2 to reconfirm your application status.

That's it...

I have applied after 2 yrs... You need to apply ONLY after 2 yrs, otherwise they will reject the application... they will consider only after 2 yrs.

Of course Bfa/German Govt., will make lots of money on this... but it is useful for elderly peoples pension... That's the reason we are there!!!

I think in India also we will not get our employers contribution, as i have taken my pension about 11 yrs ago!!! received only my contribution i think!!!

-If yes, then, to whom is this tax payable.. The German govt or to the Govt the person is resident in?
-Is there any law that stops someone from keeping his bank account in Germany active even when he is not staying in Germany anymore and then to receive the pension money in this account ?

Jane,

depending on your country of residence your country may tax your money.
You are allowed to maintain a german bank account even after leaving germany. and you can use this account for your refund collection. this way it is faster than you giving a foreign account which will take 2-3 months more than the local bank.

In case of lost , is there any option to transfer it to pension account of other EU state ?
I will always prefer to get this money but dont want to losse it in case of EU laws.

@jose,
if you moved to another EU, then there are two options:

1) You show them that you left Germany without many your current Resident and apply from your home country (other than EU, 3WC->third world country, if so). You will get only your contribution 50%.

2) For EU, if you working there, you must be paying RENTE there as well. If so, you may inform German Insurance, and they will be happy enough to get your contributions from other EU country, or that new EU country may get your contributions as transferred. But, in both cases of 2), you dont get your contribution suddenly, but only, if you move back to your country.

I think, if you re-check my given link, there is useful info and also you may translate that info into English to understand, if find it difficult to understand.

So, it depends upon your choice 1) or 2).

You must have something in mind, where you want to live etc. and this decision should be based upon that.

I got a letter (dated 6th July) from Bfa people which mentioned how much money I would get, about 2 months back and two days back, got a confirmation that they have asked Bundesbank to transfer the funds on 24th July, but I am yet to recieve that money in my account in India. I checked with my bank in India and they are asking for MT-103 from the bank. So I will be writing back to Bfa people about this and see how it goes. At this point, it does not feel good as I have heard that few such cases are being dragged for more than 2 years.

Q) While I worked in Germany for around 3.5 years I paid Rentenversicherung, after that I moved to UK and started working. Now my 24 months waiting period is almost over. So is it possible that I apply for my pension refund and get it in 2 months? If not can I transfer that to my UK national Insurance contributions.

Nope you will not get any money back since you are in UK. UK and Germany have an agreement you can transfer the pension money to UK pension system. Please call deutsche-rentenversicherung and give you social security number from UK.

Would be nice if you clarify with deutsche-rentenversicherung or pension system which works in UK. They will guide you through the process. Once you get the money back than coming to Germany or UK will be difficult for work.

I am having real difficult time getting this pension refund. According to Bfa people, they instructed their bank to transfer money two months back, but I have not recd. that in my bank account (in India). Checked with my local bank but they did not receive that money so far. My consultant has written to Bfa guys, but don't know when this will be resolved. Please share your experiences for such cases and what can be done to sort this out quickly.I am told that intermediate bank is Barclays Bank PLC.

They have probably transferred the amount to the custodian bank Barclays, where your Indian Bank has an account with them (Lets call the A/c no ABC123).

With every wire transfer you can send a message. The message sent to ABC123 was not complete. So the Indian bank (owner of ABC123), does not know what to do further. You should enquire with the Forex dept of your Indian Bank and give them further details about the money transfer.

This translates from German to English as:

"On this occasion, it concerns so-called "Entsendeabkommen". These intend that for the employees who are occupied by her enterprise/company "temporarily" in the other signatory a double assurance/insurance and with it the double contribution load is avoided to the pension scheme and unemployment insurance.

Also, other regulations, for example, to the acquisition of pension claims or to the payment of pensions,these agreements DO NOT contain ."

This implies the five year upper limit DONOT apply to india. The special agreement is more towards reducing company(german company and indian company) contribution for an individual sent to the other signatory state and not imposed anyway on individuals pension refund

1. Suppose a German Citizen spends his/her life in another country (Asia). I think after 65/67 years pension will be deposited in their account in Asia. For this are they need to visit Germany frequently to get their Pension?

2. Is there any Specific time gap visiting (Germany) to get Pension?

3. If not how can German Authorities know that this person is still alive?

3. Probably they will require some sort of documents so that they know that the person is still alive (as similar as here).

do not apply in 2012. apply after you have finished the 4.2 yrs.

I am an Indian Citizen. I have worked in Germany for around 2 years upto March 2010 on work permit (Aufenthaltstitel). Then I was back in India and now staying here full time.
I know that I have to fill the form V901 and send it to the bfa office in germany with all supporting documents. But I have few queries:

Do we need to visit German Embassy in India also for some verification/attestation?

At which address I have to send all the documents?

Please guide me more if you have some special advice.
