I am a GC holder (until 2007), have studied and worked in Germany since October 1999. I was unemployed in the end of December 2003. Since then I am getting Arbeitslosengeld from Arbeitsamt, which lasts 300 days (until October 2004).

The Ausländerbehörde in Munich marked my Aufenthaltserlaubnis in my passport invalid (ungültig) in December and gave me another additional sheet (Bescheinigung über die Beantragung der Aufenthaltsgenehmigung according to §69 Abs 3 AuslG) which allows me to stay in Germany until June 2004.

On May 18 I went to Ausländerbehörde in order to extend my Aufenthaltsgenehmigung. I showed all my job applications so far, but I was told to come back two weeks later. However, I went there again on June 1, but then a different person was in charge of me. He said I should come back only 2 days before the end of June, when my permission terminates!

Now I am really afraid. What should I do? What will happen in the worst case? Will they ask me to leave Germany immediately?

I heard from ZAV in Bonn that in most Bundesländer you will get an extension of the Aufenthaltsgenehmigung as long as you get Arbeitslosengeld, but in Bayern it is a little bit difficult. However, they said the situation is getting better in Munich now, several people have already successfully extended their residence permission.

Does anyone have experience with extension of Aufenthaltsgenehmigung, especially in Munich? Is there any law or regulation which can help me after being unemployed for 6 months? Does anyone know if the new immigration law coming out soon can help?

lol don't listen to him, if you do so he most likely will give you an act (which abides you to leave the country) personally, thus saving 5,60 euro post expenses.

write an official letter - request to prolong a residence permit, get his signature on it. if you do not know how to write it, talk with a lawyer ;)

Thanks a lot for your prompt reply. However, I didn't get your meaning. Do you mean that the people in Auslaenderbehoerde will sign something if I write an official letter to prolong the resident permit? What is the best way to find a good lawyer ( specialist for IT greencard holder), preferably in Munich? Since there's only short time for me now.

I have same experience like you in Bayern and I was working in Ingolstadt. He gave me an 'kundigung' after 1 year and 3 months and left me without payment 4 months (no money at all) and he done that only 1 week afther my baby has born.
So...if you go to lawers they will 'reap you off' with money (personal experience) the simply retype to you the issue from internet and order to you to pay them at least 250 € telling you that you have no chance.
Same happened to me.
Simply they all are leading by the regulations and law and no matter hom much you have Arbeitlosinggeld and how much long time, accordin according to §69 Abs 3 AuslG. you will must leave the contry.
You have a right for 'anspruch' but will not play to much in your case because you are getting the money from Bundeskasse and that make all the problems about expeling any 'auslander' out from Germany.
My suggestion, GET , FIND , SEARCH as soon as possible any job because without it it will be verry dificult.
You can go and ask for 'DULDUNG' at last case from Polizeiamt with wich you can stay in the town in which you are, and not to gou out so long as you find a job.
I really do not know how this is going on but that was told to me when I was in same case as you as my last option to stay.
The lawer where I was - Frau Brigite Wogel from Ingolstad, and she has some experience with Green Cards and if you really must to go to lawer, just go to any turkish lawer (you can find many in Munich) because they are knowing best the law for 'auslanders'.
If you do not go on the time as they have told you from 'Auslenderamt' you can prolong you time max 1 to 2 months and have a chance for searching the job. But YOU MUST find one, because after a few months period they can send you an Auslederpolizei and force you to leave the contry.
Search one job as soon as you can.....there are so many free job places in all Germany and you will make it ( I have my 4-th job place).

They have to. It's just a confirmation that they received your copy. And it is better for you to get one, because last time i was in local employment office they started from telling me that they did not get my appeals, till the time when i reminded them that they signed copies *lol*

lol that would difficult to answer. probably somebody else from Munich can give some recommendations, i know there are lots of GCs there. the only thing is that there are almost no lawyers who know "Ausländerrecht" good, just because there is a too little market in "Ausländerrecht", most of them know and are dealing just with "Asylrecht"

That's true, lawyers do nothing without money; and they are looking to get an easy money, which usually they are able to get from foreigners emoticon

Nope, not quite so. Arbeitslosengeld comes from insurance; Arbeitslosenhilfe and Sozialhilfe - from taxes. A submitted application on last two ones, which come from taxes, is a reason to expel a foreigner, even if he has an unlimited residence permit. there are exeptions to that rule, one of them (aufenthaltsberechtigung) will be cancelled with a new
immigration law.

As far as i understood he has a right for 10 months Arbeitslosengeld but his residence permit ends when he received it only during 6 months, therefore his residence permit can be prolonged on 4 other months if everything is done correctly. after that point of time person can avoid expelling if, for example, it happened so that he lost his passport - just because it will take time for officials to get corresponding documents from his embassy in order to be able to expel him. all that time he can look for a new job

One-two weeks, no more, so long it will take them to send their decision through post.

They send you an order to leave the country till some specified date first. if you do not abide, do not get another residence permit, do not make a RIGHT appeal (right appeal = appeal + application to the court of law with a request to grant your appeal an "aufschiebene Wirkung") and you have your passport with you, they deport you by force.

if you have "Arbeitslosunggeld" up 10 months you can have vizum up to 10 m., but unfortunatelly it's depend on decision of official. In other words ... if you have luck you can obtain vizum, but it will be as present, not as right. Unfortunately in Bayern officials have more freedom to kick out IT specialists.

What I can advise you ... just be presentable and polite in time of your visit in AB.
