If you are married to a German citizen than your situation is completely different.

Usually you will get a limited permission to stay with a duration of three years from the beginning. After five years it will be possible for you to get an unlimited permission to stay.

Even an unlimited permission to stay does not mean that deportation under certain circumstances is not possible for instance if you come into conflict with law and your sentence exceeds a certain limit.

You will have the equal rights as a German citizen regarding your permission to work.

Sorry to mention that: If your marriage should fail after two years as a lawful permanent resident in Germany your right to remain in Germany will no longer depend upon your marriage with a German citizen.

Unemployment is high. Being a foreigner myself I can asure you that being a foreigner is always more difficult than being at home.

German language is essential if you want to work. Think about the possibility to be without a job for a longer periode. Your wife will have to earn the money at the beginning. Can you cope with this situation of being the houseman? Can your wife cope with this situation, too?

As long as you are married to a German citizen you will be not a normal foreigner.

As a normal foreigner you should never receive social aid (Sozialhilfe) for a longer period of time.

What you hear in this forum is nonetheless reality for those who are normal foreigners. Their desperation is true.

§ 23 Ausländische Familienangehörige Deutscher
(1) Die Aufenthaltserlaubnis ist nach Maßgabe des § 17 Abs. 1

1. dem ausländischen Ehegatten eines Deutschen,
2. dem ausländischen minderjährigen ledigen Kind eines Deutschen,
3. dem ausländischen Elternteil eines minderjährigen ledigen Deutschen zur Ausübung der Personensorge

zu erteilen, wenn der Deutsche seinen gewöhnlichen Aufenthalt im Bundesgebiet hat; sie kann nach Maßgabe des § 17 Abs. 1 auch dem nicht-sorgeberechtigten Elternteil eines minderjährigen ledigen Deutschen erteilt werden, wenn die familiäre Gemeinschaft schon im Bundesgebiet gelebt wird.

(2) Die Aufenthaltserlaubnis wird in der Regel für drei Jahre erteilt. Sie wird befristet verlängert, solange die familiäre Lebensgemeinschaft mit dem Deutschen im Bundesgebiet fortbesteht und die Voraussetzungen für die unbefristete Verlängerung noch nicht vorliegen.

(3) § 17 Abs. 5 und die §§ 19 und 21 finden entsprechende Anwendung; an die Stelle der Aufenthaltsgenehmigung des Ausländers tritt der gewöhnliche Aufenthalt des Deutschen im Bundesgebiet.

(4) Auf sonstige Familienangehörige findet § 22 entsprechende Anwendung.

that is true, but why do you think that happens? because officials care more for spouses of german citizens than for other foreigners? hha. they care the same for everybody, including their own citizens. the thing is that when foreigner is alone, it's possible to deport him and forget about everything - no man, no problems; but it's not possible to deport his german spouse who may start making big trouble to officials and politicians. therefore politicians even made corresponding entries in laws and VwV so local officials will not do anything stupid towards such "priviledged" foreigners even if they would like to try taking chances.

i mean you could say the same about U.S. citizens for example: if you are U.S. citizen, you are not a normal foreigner. there is even list of so-called "reliable" countries *lol* reliable in which way? that there is less crime there and that foreigners from those countries are better? hha. i guess the crime in U.S. is higher than in any other country. those countries are reliable, because they will stand up for the rights of their citizens and can make so many problems to Germany when the rights of their citizens are hurt that Germany prefers to treat them somewhat different

Every single word you say is true.

Not being a normal foreigner depends exclusively on the fact that someone is married to a native citizen of that country he is living in.

If you get divorced than you are with some exceptions a normal foreigner again.

Absolutely right. But after eigth years someone would have the chance to apply for the citizenship.

It is just offering a more secure chance if someone should be in love with a native person right now.

in U.S. you will be kicked out in 24 hours, should your ex-spouse blame you in a fictive marriage solely for the purpose of getting a PR. in Germany you get your own PR in three years? of course, you have to remember that in Germany you will have to give away a very large part of your income to your ex-spouse, once you get divorced that is. it's easily explainable however, considering that in U.S. government pays almost nothing for those in need while Germany has a very profound system of social security.

however you see, everything can be used in different ways. therefore U.S. will have no problems kicking out a supposed terrorist while Germany surely will, as those people come, find a german lady that does not want to work and then they are all set, and even a new immigration law is not going to change that.

as well as natives that do not see it fair to give away so much for one mistake in their life: they usually receive "Arbeitslosenhilfe" and work "schwarz" in the same time emoticon

Some Turks btw are doing even better: they get a social aid for the whole family and work "schwarz" in the same time. which is perfectly understandable considering how many children some of them have emoticon

Independent right to stay in case of marriage

During the first two years the right to stay of a foreigner depends upon the married living together.

If a foreigner lives married together - it is not enough just to be married and live separated - for the minimum duration of two years and after this two years the foreigner is no longer living married together the foreigner has acquired an independent limited right to stay for one year.

The foreigner will in this case not receive a PR but only a one year extension of his limited permission to stay. The limited permission to stay can then be renewed as long as the foreigner does not fullfill the prerequisites for unlimited extension.

The foreigner of course has to fullfill the prerequisites for limited extension.

Receiving social aid for such a foreigner whose living married together failed after two years is permitted during the first year without scrutiny by the Ausländerbehörde.

After one year the foreigner has to stand on his own feet because the Ausländerbehörde will try to find out why it is still necessary for the foreigner to receive social aid. Then limited extension can be endangered if the foreigner has no good reasons as explanation for his prolonged reception of social aid.

§ 19 Eigenständiges Aufenthaltsrecht der Ehegatten

(1) Die Aufenthaltserlaubnis des Ehegatten wird im Falle der Aufhebung der ehelichen Lebensgemeinschaft als eigenständiges, von dem in § 17 Abs. 1 bezeichneten Aufenthaltszweck unabhängiges Aufenthaltsrecht verlängert, wenn

1. die eheliche Lebensgemeinschaft seit mindestens zwei Jahren rechtmäßig im Bundesgebiet bestanden hat,
2. die eheliche Lebensgemeinschaft rechtmäßig im Bundesgebiet bestanden hat und es zur Vermeidung einer besonderen Härte erforderlich ist, dem Ehegatten den weiteren Aufenthalt zu ermöglichen, es sei denn, für den Ausländer ist die Erteilung einer unbefristeten Aufenthaltserlaubnis ausgeschlossen, oder
3. der Ausländer gestorben ist, während die eheliche Lebensgemeinschaft im Bundesgebiet bestand, und wenn
4. der Ausländer bis zum Eintritt der in den Nummern 1 bis 3 bezeichneten Voraussetzungen im Besitz der Aufenthaltserlaubnis oder Aufenthaltsberechtigung war, es sei denn, er konnte aus von ihm nicht zu vertretenden Gründen nicht rechtzeitig die Verlängerung der Aufenthaltserlaubnis beantragen.

Eine besondere Härte im Sinne des Satzes 1 Nr. 2 liegt insbesondere vor, wenn dem Ehegatten wegen der aus der Auflösung der ehelichen Lebensgemeinschaft erwachsenen Rückkehrverpflichtung eine erhebliche Beeinträchtigung seiner schutzwürdigen Belange droht, oder wenn dem Ehegatten wegen der Beeinträchtigung seiner schutzwürdigen Belange das weitere Festhalten an der ehelichen Lebensgemeinschaft unzumutbar ist; zu den schutzwürdigen Belangen zählt das Wohl eines mit dem Ehegatten in familiärer Lebensgemeinschaft lebenden Kindes. Zur Vermeidung von Mißbrauch kann die Verlängerung der Aufenthaltserlaubnis in den Fällen des Satzes 1 Nr. 2 versagt werden, wenn der Ehegatte aus einem von ihm zu vertretenena Grund auf die Inanspruchnahme von Sozialhilfe angewiesen ist.

(2) In den Fällen des Absatzes 1 ist die Aufenthaltserlaubnis für ein Jahr zu verlängern; die Inanspruchnahme von Sozialhilfe steht dieser Verlängerung, unbeschadet des Absatzes 1 Satz 3, nicht entgegen. Danach kann die Aufenthaltserlaubnis befristet verlängert werden, solange die Voraussetzungen für die unbefristete Verlängerung nicht vorliegen.

(3) Die Verlängerung der Aufenthaltserlaubnis kann unbeschadet des Absatzes 2 Satz 1 versagt werden, wenn gegen den Ehegatten ein Ausweisungsgrund vorliegt.

(4) Im übrigen wird die Aufenthaltserlaubnis eines Ehegatten mit der unbefristeten Verlängerung zu einem eigenständigen, von dem in § 17 Abs. 1 bezeichneten Aufenthaltszweck unabhängigen Aufenthaltsrecht.

AuslG § 25 Unbefristete Aufenthaltserlaubnis für Ehegatten

(3) Die dem Ehegatten eines Deutschen erteilte Aufenthaltserlaubnis ist in der Regel nach drei Jahren
unbefristet zu verlängern, wenn die eheliche Lebensgemeinschaft mit dem Deutschen fortbesteht und die in
§ 24 Abs. 1 Nr. 4 und 6 bezeichneten Voraussetzungen vorliegen. Im Falle der Aufhebung der ehelichen
Lebensgemeinschaft findet Absatz 2 entsprechende Anwendung.


§24 (1) Die Aufenthaltserlaubnis ist unbefristet zu verlängern, wenn der Ausländer
4. sich auf einfache Art in deutscher Sprache mündlich verständigen kann,
...
6. kein Ausweisungsgrund vorliegt.

lol it's three years and you get a PR, unless you do not speak German (which is hard to imagine in case of marriage on a german citizen) or you are a proved criminal. however if you are a proved criminal then neither PR nor marriage on german citizen is going to help you to avoid deportation.

But this is only true if the foreigner lives married together with a native for 3 years.

It is not true if the foreigner's living married together fails before 2 years are finished.

sure. still it's 3 years and you have PR firmly in hands, without any need to speculate about intentions of politicians. however, CDU/CSU had an idea that this period of time has to be prolonged so nobody can be sure that this possibility will still exist after couple of years.
