I just wanted to inform you guys that I have got EG on my residence permit today. I have been working in Germany as Greencarder for less than 3 years but this does not seem to have an effect in my case.

The lady at ABH aggreed to give me "EG" just after I said I was a greencarder.. For me, this was easier than I expected.. she didnt even ask whether I have a job at the moment or whether I have paid x months of Social Insurance.(no written "Auflage Änderung" petition etc.. everything done verbally)

With §46.2, I guess this is the correct way for GClers, but some ABHs are not willing to do it quickly, as we read here in the Forum. I just wanted to share my "positive" experience with my ABH. I am in BW, by the way.

Btw, what made you go to the ABH? Job wechsel or so? Or just wanted to try your luck?

What was your main argument? That the law has changed and so you want EG, or that you wanted to work as a Freelancer?

I can´t get it what you´ve done to convince the lady (because you are less than 3 years here) but I would like to know it because is my case also.

Where do you live? What says in your pass?

Exactly same thing happened to me. I just went there and told them that I would like to do freelancing work and start my own company. The guy did not ask for any documents and within 5 minutes I had my new permit. Amazing!

Thanks. My motivation was to change my job. I am actually seriously thinking about changing my job but I just told them this intention verbally. They didnt request from me a concrete job offer or a new contract.

She seemed to be really well informed regarding GC. I didnt have to convince her. I just told her that I have intentions to change my job and whether I need a new work-permit (Zustimmung der Arbeitsagentur)
She looked at my passport and she offered me to change the condition on my passport. (what she told me was that every "greencard" work-permit which was issued before 1.1.2005 can be considered as "EG" now. She requested a copy of my old work-permit, the yellow one which was issued when I first got my greencard and that was it. She just put a new sticker with EG)

I live in Stuttgart area(BW) and in my pass there used to be a clause like:


Erwerbstattigkeit nicht gestattet. Ausgenommen Tatigkeit als IT-Fachkraft. Erlischt mit Beendung der Tatigkeit.


I was worried regarding this "Erlischt mit Beendung der Tatigkeit" part. But now I have only
"Erwerbstattigkeit gestattet". There is also now a reference to law §18 Aufenthaltsgesetz

which basicly says, ABH can give work-permit to foreigners where there is no need of "Zustimmung" from Arbeitsagentur. I think my ABH considers BeschV §46.2 to be good enough for §18 Aufenthaltsgesetz.

Your experience and what had happened to Xenon123 maybe shows any kind of those "secret internal ordinances" that finally mention our cases isn´t it?

I think everyone with a GC should go and try this. I think all of this has to do with the rules changes that happened this year. There is no GC anymore and I think everyone automatically gets the full permit. I think if you lived 3 years or longer here there should be no problems.

I mean, I asked for a change in my visa 3 months ago in ABH-Stuttgart but I only got BE and not EG. They told me that I needed to invest €1 Mi. and so on to get EG.

where exactly did you do that in München? I'm planning to ask for a time extension on my visa because it will expire on may 2006 (when will be my first 5 years in Germany) and I'm facing problem with that (i.e to buy a handy for contract duration, etc). Maybe it would be a good oportunity to try to get EG (if it is what you got)...

@alex: I went to the Kreisverwaltungsreferat on Poccistrasse. Go to the first floor where they handle all the work and residency permit issues. There you have to take a token and talk to the guy you get assigned to.

My permit also expires in May 2006. I think after 5 years you automatically qualify for 'Niederlassungs erlaubnis' which is the permanant residency. But make sure you do not wait till may to apply for it. Do it at least 2 months in advance.

grave mistake. because you do not have to pay any contributions to pension insurance any more if you will be self employed, and the government already has loots of problems with covering costs for pensions.

I just came back from the KVR in Munich but the new lady there didn't agree to give me the EG, instead I have on my passport:

"unselbständige Beschäftigung gestattet
Selbständige tätigkei nicht gestattet
Erteilt am ...
Keine weitern ..."

I showed her the law §46.2 but she still insisted that I am not allowed to get EG.. Although she seemed not so confident and always refering to the law book in front of her but she seems very determined not to give me EG.. After going home I noticed that there is a small mistake in my name on the Visa. So I will have to go and correct it and in the same time perhaps try to convince her to get the EG. Could anyone please help me to point out the sentences in the laws that show that I am entitled to the EG.

It is maybe worth mentioning that I have been in Germany more than 4 years and always employed in the same comany.

According to BeschVerfV §9 you satisfy both conditions of getting Be or Eg but as some other members of this forum commented in the last few months it is up to the Beamte what she will give you.

Tell me, is the visa you got now time limited? If yes does it matches your Arbeitserlabnis(your previous Aufenthaltserlabnis) or it is Unbefriestet?

Yes it has excatly the same expiry date. I didn't expect anything to change here since I still have 10 months to complete my 5 years!

On the other hand, please experts do you know how can I convince her that I am entitled to the EG.

You are not entitled to EG, you can get if you are lucky and if the ABH officer is "generous".

However you are entitled to "Beschaftigung Erlaubt" and the corresponding law paragraphs concerning this issue has been discussed and mentioned almost in every thread in this Forum.

You are pointing hfm01 to the §9 paragraph from BeschVerfV? This one says about the Eg or Be? I assume the Be but I do not see a clear difference what they meant with

This "Zustimmung zur Ausübung einer Beschäftigung" means only the Be and not the Eg?
If so, where is the paragraph about Eg?

Some ABHs do not interpret it as EG but as BE. Whether they are correct or not, I can not really judge.

Is it same?
Or if I get this Permanent residence can I work as a freelancer?

Hi,
NE is unlimited work and resident permit. EG is also included in NE. EG is for people who are still not eligible for NE.

This is the shortest summary possible about NE vs BE.

I hope you dont mind answering some of the basic questions i have regarding NE,BE,EG.

I am being offered a specialist position in south germany & salary is expectd >63,000K euros. I am currently living and working here in denmark and was very positively surprised to know that there is a possibility to recieve " Permanent Residency"in germany from day one if you fall in highly skilled category with salary > 63000 Eur/yr

After a few hours of reading different topics sub topics and comments relating to NE,BE,EG on this website,I must say that there are still some un answered questions. Especially due to the fact that these abbrevations ( BE,EG,NE etc) are totally new for me and there seems to be more type of work&residence permits in Germany than what we have here in denmark ( there is basically a limited work permit or unlimited/Permanent residency)

ii) Apparently germany also issues "Permanent Resident Permits" ( After 5 yrs of work and stay)

NE is abbreviation for Niederlassungserlaubnis, a german word which means unlimited residence permit.

EG Erwerbstattigket gestattet
This kinda work permit let one take/do any type of job.
employee/self employment(freelancing)/business etc.
If one has NE, then ultimately they have all the above rights.
but sometimes,ppl can get EG before NE.

BE Beschäftigung erlaubt
this is company independent visa. usually in Germany, work permit is bounded to the company.
after two years,they get this BE which let them easily switch to another company.


Since you would fall under >63000 K salary, you may be eligible for NE directly.
in that case,don't worrry about
all these EG,BE etc.
