Hi all,

I'm a GC holder working in Germany since 2003 under (§2 ITAV ; Aufenthaltsgenehmigung erlischt mit Beendigung der Tätigkeit als IT Spezialist ber der Fa. XYZ GmbH).

My wife is a house wife and she has the following visa: Aufenthaltserlaubnis §30 Abs.2; Erwerbstätigkeit nur mit Zustimmung der Ausländerbeh. gestattet. Die Aufenthaltserlaubnis erlischt mit Beendigung der Beschäftigung des Ehemann es als IT-Spezialist bei der Fa. XYZ GmbH.

We got a kid in Apr-2007 and we applied for Elterngeld for my wife. Today we got a letter from Elterngeldstelle saying they can't give elterngeld to my wife as she doesn't have Niederlassungserlaubnis or Aufenthaltserlaubnis mit Erwerbstätigkeit berechtigt.

Did any of you got this problem? Is it really true that my wife isn't eligible for Elterngeld? Please through some light on this issue. The Trust7 FAQ section says that non-working partner of GC holder is eligible for minimum Kidergeld.
