Dear Friends,

Today I went to the Landkreis Wolfenbüttel (Lower Saxony), to get information for my husband workpermit who is presently on spouse visa. We came to Germany in the beginning of October. At the time of getting Resident Visa in Wolfenbuettel, they said that he has to find an employer first, and the employer should apply for workpermit(Exactly the same proceedure that took place for my workpermit).

Today I went again to ask the same, because I heard that after 1 year he will receive the automatic workpermit while renewing the resident permit, based on my work contract renewal. But they are not agreeing with this. Also sometime ago I heared from Shoppi (Trust7 User), that, with the new law §29.5 effective from 1st Jan 2005, he is eligible to ask for starting workpermit right now.

But again they are not accepting this.

Could someone please clarify on this? If possible could you please send me some strong article explaining the new laws and rules, that will let my husband to ask for automatic work permit, which is not employer based.

The content written in my husband's passport:
"Erwerbstätigkeit nicht gestattet. Nur gültig zur Begleitung des Ehemannes."

In my passport:
"Nur gültig für eine Tätigkeit als Datenbankkommentorin bei Employer name"

If he can ask for automatic working permit(not employer based) after 1 year, that seems to be much better for us, to have some hope and to continue our stay in germany.

Please enlighten me on this.

Shouldnt it be "Nur gültig zur Begleitung der Ehefrau" ?

your ehemann can get visa binded to company after 1 year but only if he finds a job. After 2 years he can get unbinded even without job I think.
If you are GC you can get visa binded only to IT but not to company immidiately according to §42.2.
