Ich war bei der ABH, habe Antrag auf Aufhebung der Auflage (GC --> "Beschäftigung erlaubt" ) gestellt. Der Antrag wurde abgelehnt. Mir wurde gesagt, dass laut interner Regeln von der ABH, für GC-Inhaber die § 9 BeschVerfV nicht gilt, was zählt ist nur § 46 Übergangsregelungen BeschV.

Hat jemand eine Idee, was ich jetzt noch tun kann?

Ich habe es gekriegt, meine Frau hat es gekriegt, andere Leute haben es auch gekriegt.

Du sollst jetza' Wiedersprüch einlegen also die Begründung von ABH als Rechtswidrig zu bezeichnen, weil § 9 BeschVerfV allgemeine Gültigkeit hat.

Selbermachen oder Rechtsanwalt sollst du selbst entscheiden.

Oder vielleich auf Boarisch sogn' des die Begründung eifach Schmoarn ist.

Du kannst dich auch an einen Herrn Conradt aus der Bundesinnenministerium wenden, der die Antwort auf Schreiben bezüglich GC Problemen geschickt hat. Dann kriegt vielleicht die Zuständige ABH einen auf dem Deckel. Guck mal mehr unter http://www.e77.de/download/

Ich war bei ABH in München. Mir wurde deutlich gesagt, dass es einfach nicht geht. Ich wollte irgendwas schriftliches haben, das es nicht geht. Es wurde auch abgelehnt. "Sie fragen zuviel." sagt der Beamter zu mir.

Hast du Antrag schriftlich gestellt.
Wenn nicht, mach das.
Wenn ja, stelle Widerspruch schriftlich.
Wenn es abgelehnt wird muss du Klage erheben.

if you want any answer/decision in written form, you have to apply also in written form.

Prepare an application about what you want; the ground for this (e.g. § of the law) and the documents supproting this.

Go to the ABH and ask them to accept it. Do not care what she/he tells you. Just submit it.

In some weeks you will get what you want in written form.

well, it doesn't surprise me. They call this in german "gummiparagraphen". It can be bent they way you want it. I don't understand why you guys are so keen on staying here, why not go where you are welcomed. Foreigners are always and will be always foreigner here, think of your kids.

PS: the stupid bayern act as if they are a different country, really stupid. Remember bayern doesn't have GREEN card, it has BLUE card, that is not a joke.

There is no blue card, also not in Bayern. This was info from Arbeitsamt (on website). Blue card was just political gag, without any legal meaning. But now there is no green card and also no blue card.

Wanted or unwanted, who cares ? The only thing that counts is the law. If some ABH or single employee has problems with understanding what is written in the law this is completely different topic.
