Indian Passport for New Born - dual citizenship problem

Hello All,

Our new born is currently having both Indian and German citizenship but we want to apply for an Indian passport. Consulate is not agreeing to accept our application inspite of submitting the letter stating we have not applied for any German passport.

On the other hand Auslanderbehorde is unaware of how to revoke German citizenship.

Finally we have started thinking in the direction of getting him German passport and PIO card but unaware of any major problems in future if we return to India for good.

Please let us know od possible problems in future caused by having German Passport and PIO card for baby .

Also if anyone else faced the same situation, please share the solution to get Indian passport.

Hi,
I would suggest to apply for German Passport and OCI card. There will be no problems in future, you can get Indian citizenship once you are back in India for a period of 2-3 years. This you can check in OCI card conditions.
Having both Indian and German passports is not legal. If you want to revoke German citizenship you should go to Einbürgerungsamt (It would be normally in Rathaus) and then apply for Indian passport. Auslanderbehorde has nothing to do with German citizenship.

Please let us know of the procedure if anyone has got this done through Einbürgerungsamt successfully.
We have been trying from long time now to get this done. I read that at many other consulates just a hand written letter stating we have not applied for German passport can get work done but it is not the case for us.

We are very unsure now if we can get Indian passport for our baby.

Whats the reason for denial of Indian passport to your child ? Did the Indian consulate give you in writing ? Because Section 8(2) of Indian Citizenship Act 1956 says that the child would disqualify for Indian Citizenship if either of the parent has acquired German / Foriegn Nationality. By the way we took up this matter with Indian Consulate General in Frankfurt few months back as the law is clearly defined but the interpretation is being debated as always.

Hello Richtich,

We are both having Indian citizenship. Consulate here wants that he should be mentioned only as Indian on all the documents. Which is not the case now because baby now as per German law is having both Indian and German citizenship.

Ideally we need to renounce the German citizenship but the German authority here says they cant do this.
