Dear Friends,

I accepted a job offer 4 months back and currently not able to join the new company due to some personal reasons. According to the contract, it cannot be cancelled before beginning the job on 1.03.2009.

Does anyone of you know the consequence of terminating a signed work contract?

Any help appreciated.

Did you talk with the company where you signed the contract? Maybe they will let you go. But in the worst case you may have to join the company and give the kündigung in the first day. Look into your contract and see the details for Kündigung during probation period. Max 1 month you have to work.

As raj said, first check your contract.
It is now upto the company, more chances are that they let you go if you expalain. If they really spent lot of time on you and it ihas some impacts on their business they can ask you some panelty or at least you need to join there for a month and kundigung the same day.

i am sure nobody will force you to join comapny which you dont want, but they have right to disturb you becuase you now frustrated them. Check your contract, you will find all answers.

Did you start already?

There is ALWAYS a clause in your contract that says "the contractual relationship don't start until the person XXXX starts the job"

So, after reading your post, maybe is not that difficult if you don't started yet.

PS: the contract cannot be cancelled because it never started!

It seems to me unuasal that they bind you for so many months in advance. Go and look into the contract. Do they give a reason that it cannot be cancelled before beginning of job?

If the contract is in German and you dont know German very well, consult a lawyer. We havnt read your contract.
