Dear Folks,
[sorry for the long post, but just wanted to explain the whole thing]

I have been living in Germany for a while, studied MSc here and after finishing my studies last month just joined a company in Dresden since November. Living here was mostly enjoyable unless this country (specifically Dresden) would not have produced some retarded people in their auslaender behoerde. Let me try to explain the situation.

My wife have been trying for a spouse visa since a while. Well, almost 3 years. She has been rejected 2 times alredy while I was a student. And the reasons were simply unbelievable. The first time she applied as a spouse, this foreign office here informed me that it is not legally possible to bring my wife because I dont have a "Hochschulabschluss"! What a crap! If I would not have a University degree already why should the university accepted me for the Masters degree? I even brought a paper from the Uni written that my last B.Sc. degree is a definite equivalence to the so called "Hochschulabschluss". But despite of this, they simply denined the visa application. The 2nd time, she had a PhD admission(she already had a M.Sc. degree from home) here at the same university where I was studying. This time they said that my wife doesnt actually want to study and because she only wants to stay with me (!!) so they were unfortunately unable to accept her application this time as well. What could I say more!

So I have been living in this democratic(!) state for 2 years now, staying away from my wife. The suffering was enough, thats what I thought. But now as soon as I have a job and a GC, naturally she applied again in October this year (the 3rd time). And that I thought "finally" we would be together, but never knew what this people could do this time. Yes, they are still alive. So after almost 2 months that she applied this time, they are still making problems with granting the visa. They are asking for some kind of papers and when I am bringing them in, they are asking for the next one. And now I am actually waiting for another paper. All the documents were submitted by my wife at the office in the Home country (with my work permit and residence permit and all kind of things possible) and then they sent a fax to this office here with the copies. (Well, it took them 33 days to do this and they only did it cause I made several phone calls to them after waiting for a month!). Now that these copies are here, this office in Dresden are now asking for the original documents from me! What a pity! All originals are already provided to the embassy at home. And if this local office here cant rely on the sent fax from the embassy at our homeland and then again ask to send the originals, then why should they pay for an embassy in our country! So I called again the embassy at home and requested them to give the original documents to my wife so that she could send it by a faster medium like DHL or so. ANd the embassy replied me that they would only send it by a normal post and cant give them instead to my wife. This is how they work. So I am just waiting on their mercy when they would kindly send it and after another couple of weeks this post may arrive here and then this office here would just ask for some other documents. Or may be they will find another very important reason to reject her and will glady do so.

Now this is my long post...sorry to bother with all these details. But what is our right in Germany as a GC holders? Why do the german govt. issuing GCs and still making it so damn difficult for their spouses? I am from a very poor and corrupted country, but I dont think even in the corrupted most country of the world this situation would not have been worser than in my case in germany. My company says they cant influence the local embassy, but they were also surprised at this situation. NEvertheless, I am now thinking of packing my bag and just leave this whole thing behind. Before I would leave, may anyone tell me if there is anything that I may legally do against this stupid office?

I am really sorry to hear this from you. I came with my wife to study here in August 2000. She was not accepted as a student so she applied for spouse visa. The visa officer in India, just asked me why i am married so early in my life( just a stupid question!) I told her that it is my wish that i marry or not marry after 18 years. Then came the answer from her, do you have money? I told her yes, i can proove but they accepted without proof her aplication but she has to wait for an answer from Germany that it is ok for them. In 2 weeks, i was in germany and i went immediately to the auslandsamt. I asked if they know anything about my wife's application, they told me to wait for a few minutes and then this woman spoke something with my university coordinator she then told me to ask my wife to enquire immedtely in the home embassy. My wife went the next day and she got her visa. She came to germany and now we live her since 2000 and we already got 2 children here..

We all students in that university were well supported from the auslandasmt and never in our student life we had problems.

So, i think it is just case to case basis and you cannot fight for justice as the beamter has thr right to accept or refuse.

In 2000, hardly anyone came to germany from India, now things have changed..so they might think that students are potential immigrants and they might even refuse even if you have a scholarship to study..Just like what the US embassy did to thousands of students in india in the early 90's

Just keep cool, i think your wife should get visa as you have a job.

please follow Detlef's advice.. You have to go with a lawyer to make things happen

I personally feel that it is sheer injustice to seperate Wife and Husband.. I think we are in Germany( Open, democratic, free) not in any Gulf Countries

i also had the problems to bring my wife when i was a student. i also had the same feeling to pack-up my baggage from germany. but this is not the solution. i have studied and searched lots to fight for this. i can say they can only delay to issue the visa. they do not have the ultimate power to refuse your wife. they must issue it today or tomorrow. i even know a case, when a guy complained at the foreign ministry for the help. the officials at the foreign ministry handled the case. then the embassy was forced to issue the visa. germany is not like the usa. here you can fight - and definately you will win here.
you just have patience. all should be fine.
yes, ofcourse you can take a lawyer to fight for this. the lawyer must be able to bring your wife.

Dear all,
Thanks for your kind posts, information, advice and most of all what I say is a very warm mental support which was unfortunately missing in the last days/months/years. I even received some emails with very important information and some of them were even new. I regret that I didnt write for a help here before.

Now just a simple question, will these harrasements will still continue? Even though you are such high qualified and have proved more than what you should and still have to be humiliated by these people/offices? Is that only the specialist like me or you need Germany rather than Germany need us? What I felt often with all these buerocracy in all these years, that as a human, there is a certain limit that I may lower my head to someone who hardly deserves it.

I would do anything to avoid such kind of harrasement, that I had, to anyone who would like to come over here for work or study.

before getting lawyer, get a Rechtsschutzversicherung.
but your spouse visum is allmost there now.

btw, if you were here as a student long time, you can add it in 5 years Frist.
btw, you don't need 60 Renten because you got AE (GC) before 1.1.
so if you studied hier 5 years you could get PR immidiately after 1.1.

do not bind those events with whole Germany.
Bureaucracy is in other countries also often shitty.
it just happends when idiot gets position there.
but they are in big majority nice.
I never had bad experience with AB.

btw here are at least law and court allways decent so you can get justice there, when you get stucked with idiot.
