I am working in Germany from Nov 2011. My resident permit expires on OCT 2013. 

I want to know

1. Whether, if i apply for BC now, i will get employer independent workpermit?

2. The period before before getting the BC will be counted for resident permit?

1) In principle, a BC for the first 2 years is tied to an employer. I strongly believe you will have the same condition. But the process of changing employer is straightforward. You just have to notify the ABH and they check if the new contract fulfils conditions for BC.

2) Yes and No. I started directly on a BC and I got 4-year validity on it. A friend of mine finished masters, got a job and applied for BC. He got 5-year validity. Depends a lot on the clerk who handles your file.
