Übergangsregelungen
(2) Die einer IT-Fachkraft nach § 6 Abs. 2 der Verordnung über die Arbeitsgenehmigung für
hoch qualifizierte Fachkräfte der Informations- und Kommunikationstechnologie erteilte befristete
Arbeitserlaubnis gilt als unbefristete Zustimmung zum Aufenthaltstitel zur Ausübung einer

Zu § 46 - Übergangsregelungen
Zu Absatz 2:
Für IT-Fachkräfte wird mit der Übergangsbestimmung die zeitliche Befristung der erteilten Arbeitserlaubnis
aufgehoben und - wie für andere qualifizierte Beschäftigungen auch - die dauernde
Zulassung zum Arbeitsmarkt durch Fortgeltung der Arbeitserlaubnis als unbefristete Zustimmung
zur Ausübung einer Beschäftigung eröffnet.


Also NoBody they clearly state that time limit to GC is history.
Of course this document has to be accepted and it will happend soon.

This people get the german nationality after some years and they becomes more germans than the germans itself.

hello all,
i want to continue to carry on the discussion of BeschV.
1) Now at present arbeitserlaubnis is given on a companies name.
what happens to this erlaubnis after 1.2005. Can we change to a normal erlaubnis without any company string attached to it.

2) I want to ask the same as above for visum also.

3) After 1.2005 are we eligible to work as selbststandiger, or will it become easier.

4) After 1.2005 can we change our working area like Z.B from IT to management or IT to Biotechnology etc.

If none of the above questions have a "yes" as a answer then the new immigration law is no good, it is just another mouse trap.

I hope german government plays fair and stop this cat and mouse game.

All answers are Yes after you fulfill 5 years and get NE.
It could be true even if you do not have 5 years but I don't know for sure.
I know that after 1.1.05 they can give you all those things you asked,
but I don't know if they have to do it

it will be good if they are true for points 1,2 and 3 without having NE.
I think they should give all of them for the following reasons

1) for points 1 and 2 freedom to choose for whom we work is very important to increase productivity and also job satisfaction.
if both 1 and 2 are not possible then the job amounts to slavery, booring and it leads to destruction of his career.

Not all people come to germany just for money or only to boost the germany economy as the government thinks. They come here to have a good life with freedom and have a good career. ( some people come from countries where they have more freedom than buerocratic germany).
Boosting the economy is just a by product. Forieners are no money producing machnies,they too have a human life.

3 & 4) All people should be given equal oppurtunities. Integration of foriegners into the german society or germans integrating into foriegners society ;-)) can only happen if both of them are treated equal or atleast given the basic rights equal.
If they dont give the freedom to choose the career or oppurtinities,then it is not right to say most of the greencardler are unemployed.

You can also question me dont you know everything before choosing Germany.
I can say no because the government always showed the world that
the have a green card program ( trap1: this greencard is different from USA), All the conditions and clauses are written in German only the positive points of this greencard program are written english ( this is trap 2).

The beamter can do whatever they want, they can deny, reject,deport or accept according to their mood , knowledge or interpretation of the GC law.(trap3 and this is the final).

If the government thinks the whole GC program is a business and all GCs are stupid customers where they can fleece them.

If the GCs dont know how to get their rights, atleast they should know how they are fleeced.
