Hi all,

Do you know if a PhD Students that work at the University full time as wissenschaftliche Mitarbeiter under BAT IIa (and pay taxes, health social and rent insurrance) are allowed to apply for the residence permit (Niederlasungserlaubnis) after period of 5 years?

If yes, under which conditions?

Does anybody know if there need to be shown 60 continuous monthly paychecks?

if your visa is according to AufG §18 ( i guess it is so), then you can apply for NE. You need 60 months of rente and enough German knowledge.

Usually Ph.D. students are still considered students so their visas are issued based on §16, since in this case main goal of your staying in Germany is studying. You have to be either a post doctorate or a researcher/engineer not working towards obtaining a degree in order to receive visa based on §18. So if your visa indeed linked to §18, you can try to apply, otherwise you can't convert full 5 years of your study time.
