Hello,

I am having [font="Source Sans Pro", sans-serif]Daueraufenthalt EG and living in Germany for more than 15 years while my Husband has got normal Aufenthaltserlaubnis who joined me under family visa two years ago.

[font="Source Sans Pro", sans-serif]My husband needs to go to India for one year. As per the laws if he leaves Germany for more than 6 months he will loose his Aufenthaltserlaubnis but I came across with a law which says that he can be away form Germany for more than 6 months if he is married to a person who is[font="Source Sans Pro", sans-serif] living legally in Germany for more than 15 years.

[font="Source Sans Pro", sans-serif]Please correct me if I have wrongly interpreted the law under § 51

[font="Source Sans Pro", sans-serif](2) Die Niederlassungserlaubnis eines Ausländers, der sich mindestens 15 Jahre rechtmäßig im Bundesgebiet aufgehalten hat sowie die Niederlassungserlaubnis seines mit ihm in ehelicher Lebensgemeinschaft lebenden Ehegatten erlöschen nicht nach Absatz 1 Nr. 6 und 7, wenn deren Lebensunterhalt gesichert ist und kein Ausweisungsinteresse nach § 54 Absatz 1 Nummer 2 bis 5 oder Absatz 2 Nummer 5 bis 7 besteht. [font="Source Sans Pro", sans-serif]

Hi,

this should not be a problem, especially because you stay in Germany and you will not be divorced or so, which means, that your husbands 'Lebensmittelpunkt' will be in Germany. He should not deregister and to be very sure, you can contact your local foreigner office and ask for an official permission.

I have called the foreigner office and they told me they can issue a permission letter to my husband to be away from Germany for one year.
