My wife has been offered a 50% PhD position in another city in Germany.
For this reason I want to explore what our options are for her to
proceed further with her PhD.
She is on a Family Reunion visa in Germany since July 2013 and her visa
states the permission to work in Germany. I have
Niederlassungserlaubnis. Additionally, she would be completing her
Master studies from LMU in Munich around Spetember 2015. The PhD
position starts from October and will be for 3 years. Her current visa
is valid till August 2017.
The conditions for a family reunion visa state that both the partners
should be cohabiting. While this condition makes perfect sense, I was
not able to find a legal definition of the same, as we plan that she
comes back to Munich over the weekends and hence maintain her residence
in Munich.
My questions are,
- What could be the possible consequences when she maintains her residence in Munich by visiting every weekend?
- If she does register in another city (anmeldung) as a second home (zweitwohnsitz), does this still violate the conditions for a family reunion visa?
- Do we need to change her visa category if the terms of family reunion visa are no longer being fulfilled? If yes, then can she be granted a Study or Work visa based on her PhD contract
(and the fact that she'll be a graduate from a German university)? - How does this whole arrangement affect the tax class (and hence, the finanzamt)?
