I have the following query regarding the paragraph Ehegattennachzug §30 of the Aufenthaltsgesetz. Your replies of any or all of these questions are much appreciated.

1) Is it mandatory for the husband to have a Job so that the wife can be allowed residence permit under this category?
2) Does a resident permit under this category allow studying in a German university?
3) In a scenario, where the wife had the residence permit under this category in the past; but it expired because of moving from Germany; is it possible to apply for this residence permit from within Germany, given the husband's residence permit is still valid and both are moving back?

1) It is mandatory that the husband has a permanent residency.

2) Yes.

thanks for your reply with valuable information. I need one more clarification regarding answer 1. If the husband has a valid permanent residency (NE or D-EG) and moving back to Germany, is still a Job contract needed? I was informed from the ABH that a Job contract is also required; but I did not find that requirement in §30.
