Help needed!

Re: Legal advice needed against revoked job contract

Toggle
I am in a deep deep problem. I am an IT specialist with 10 yrs of experience presently working in Singapore. Recently I was offered a job in Munich. The firm sent a contract letter without even discussing my salary. I tried to negotiate the salary as it was very very low and they expected me to work in shifts and weekends. I was also given a contractual letter in German and was asked to sign the same. As my German proficiency is low, I refused to sign the same and requested them for an English translated copy. Because of my persistance for an English version, they have now stopped responding to my emails and calls. Now all of a sudden they want me to return back the contract that they had signed and are giving a lame excuse that "future relations cannot be built on salary neogiations" and are now revoking the offer. Ironically during the job interview they had asked me to join immediately and quit my existing job(at Singapore).Having a job offer and a signed contract in hand I have now quit my existing job and also applied for a work permit.

I need advice as to what legal actions could be taken against the company as I still possess the valid signed letter of contract ? I never rejected the offer, but only tried to negotiate the salary which was ruthless!!!
Any advice would be deeply appreciated!! Thank you

There is basically nothing you can do. You can sue them in Singapore or Germany. But not sure about the outcome and jurisdiction. Just look out for new jobs. But next time you get an offer from germany just dont resign from the job before getting everything sorted out including the visa!!

Dear Raj,

Thank you very much for your reply. But I need to know if I could file a complaint against the firm at the Labour Department in Germany? If at all possible where in Germany? Is this a normal practice of revoking contract when not interested by the Company as I have never heard of such a thing to have had happened.

You can't do any thing. Forget !!!
It is a waste of time and money with German lawyers for such a kind of legal case.

@icandy

could you please tell the name of this company, as a similar case happened to me...but in that case it was an agent who tried to trick me.... I simply said NO to them.

Thank you all very much for your kind help and advices!!!

@moiin76 I plan to file a complaint there and let them know abt the situation.

@vmishra In my case too there is an agency involvement and would like to discuss this one to one with you. Could you please email me the agency and the agent who tried to trick you via an email. As it would not be appropriate to disclose the name in a public domain. If it turns out to be a same agency and agent involved in both our cases, I would disclose the name in this public forum as I feel the same should not happen to anybody else in future.
