Dear All,

I am an Indian national, currently residing in Germany on a "Qualification plan"-Visa as a trainee for a company. I first came to Germany in March 2005 with a one year visa which was later extended to last till jan 2007. My company wishes to extend the visa further by one or more year.

Is it possible? what are the rules in this regards? Can you please share with me any information or links in this regard?

By the time company is ready to prolong your work contract you will definately get visa.

Which law applies to you I have no idea. Best is to go Auslanderbehorde and they will guide you what you need to bring with while appliyng.

Hi,

Thanks for the response.

In my case, my company also does not know the visa laws in detail. What I have been told is that i cannot get it extended while in Germany and have to go back to India, stay for minimum 3 months and then apply for a fresh visa.
Whereas, some other people I know of have got their visas(same as mine) extended for a total period of 3 years.

Can you please tel me any site where all these laws are explained .

Dear Savera,

it is in some cases possible to extend visas (or Aufenthaltserlaubnisse), in other cases it is not. It depends on the current AE and work permission and in most cases also on administrative discretion.

The law (Arbeitserlaubnisrecht) is quite complicated so you probably won't find reliable information on the Internet that matches exactly to your case. But have you ever thought about asking your employer to give a mandate to a specialised immigration lawyer? Many companies do this.
