Hi every one, 
My husband who was hired by a company in germany as sr. it consulatant (the contract indicates that it is for a permanent position and salary is at approx 39,000 annually) has applied for a blue card visa but got rejected. The reason for rejection was as per the embassy was:
-university degree is not recognized 
But we submitted a remonstration letter stating that besides his university qualification (B.S. INFORMATION TECHNOLOGY), he has more than 5 yrs. Of related work experience with sap but still the remonstration got rejected. 

Please enlighten us on what have we done wrong for the application to be rejected.

Did you include an official ZAB evaluation with the Remonstration?

Yes we did include the zab documents. The university he graduated from was recognized (university of santo tomas) but the degree he earned was not corresponding to any german degree in IT, but it was indicated in ZAB that he earned a bachelor's. But aside from that we also presented a certificate from his former employer that he worked for more than 5 yrs already as an SAP consultant.

His 5 years of work experience is irrelevant for a Blue Card application. He needs a recognised university degree.

What exactly did the ZAB say about the degree? Is it considered equivalent to a German degree?

According to the ZAB your husband's educational qualifications are equivalent to a high school degree plus part of a bachelor's degree. Since he doesn't have qualifications equivalent to a German degree he is not eligible for a Blue Card. Therefore, the decision is correct.

You might want to try having his qualifications evaluated by IHK FOSA and then try applying for a regular work permit. Keep in mind you will need to learn German before you can receive a dependent visa.
